This study is related to the jurisdiction of Korea Trade Commission(KTC) regarding international unfair trade practice over the infringement of intellectual property. This discussion on the jurisdiction of KTC is not a academic rather practical. I rewrite the presented manuscript in a symposium held by KTC and Korea Intellectual Property Law Association on Dec. 16, 2022 reflecting discussions in the symposium. The jurisdiction of KTC to the international unfair trade practice over the infringement of intellectual property is an important matter of KTC. However, the boundaries of the jurisdiction is not decided by KTC but the Ministry of Trade, Industry and Energy, the main government entity over the Foreign Trade Act, because “articles, etc”, over which KTC has the jurisdiction, coded in the the Foreign Trade Act. If the Ministry of Trade, Industry and Energy changes the definition of the “articles, etc” the the Foreign Trade Act, the jurisdiction of KTC changes. Finally, KTC should consider the new patterns of the international trade trends: An electric wiring trade system would be a new wave.

본 연구는 무역위원회의 지식재산권 침해에 대한 국제불공정무역행 위의 관할대상에 대하여 고찰한 것이다. 무역위원회의 관할은 학문적 이라기 보다 실무적인 필요에 의하여 고찰 한 것이다. 본 주제는 2022. 12. 16. 무역위원회와 한국지식재산학회의 공동 심포지엄에서 발표한 글에 대하여 주석과 발표시에 토론자들의 토론내용을 반영하여 다시 정리한 것이다. 무역위원회의 지식재산권 침해로 인한 불공정무역행위의 관할은 불 공정무역조사법이 아닌 산업통산자원부와 대외무역법상의 “물품등”의 정의에 의하여 정해지기 때문에 무역위원회의 의사가 아닌 산업통상자 원부의 필요성에 의해 대외무역법이 개정이 되고, 이에 따라 불공정무 역행위의 관할대상이 변경된다는 점에 큰 문제점이 있다. 나아가 전기 통신망을 통한 국제거래행위로의 무역행위행태가 변화되고 있으므로 이에 대한 대처가 필요하다.
