Purpose : This study aims to examine the composition and revised main characteristics of the Incoterms 2020 rules and to examine limitations. Research design, data, methodology : The composition of this paper is as follows. Chapter II summarizes and describes related previous studies, and Chapter III focuses on the revised part of the composition of Incoterms. Chapter IV examines the main characteristics of the revision of Incoterms 2020 based on the contents of the preceding chapters, derives the limitations of Incoterms 2020 that occur even in the revised situation, and Chapter V summarizes and describes conclusions. Results : Major amendments include the possibility of issuing FCA's bill of lading, maximum insurance coverage of CIF rules, changing to DPU rules of DAT rules, allowing sellers or buyers to transport, expanding continuous trading by procurement, and inserting security obligations into transport and export customs provisions. Conclusions : Limitations include increased burden on sellers due to CIP maximum security obligations, inconsistency between inland delivery date and main loading date when issuing FCA shipping bills, necessity of mechanical revision of Incoterms, and limitation of the scope of Incoterms regulations.

Incoterms(정형무역거래 조건의 해석에 관한 국제규칙)는 매도인과 매수인의 의무, 매도인으로 부터 매수인으로의 위험의 이전, 각 당사자의 비용에 관한 조건을 규정하고 있다. 1936년 처음 제정되어 8차례의 개정 이후 최근 Incoterms 2020이 사용되고 있다. 본 연구는 Incoterms 2020 규칙의 구성 및 개정된 주요 특징을 살펴보고 한계점을 살펴보고자 한다. 개정된 주요 내용으로는 ① FCA의 본석적재 표기 선하증권 발행 가능 ② CIF 규칙의 최대 보험 부보 ③ DAT 규칙의 DPU 규칙으로 변경 ④ 매도인 또는 매수인 자신의 운송수단 허용 ⑤ 조달에 의한 연속 매매 적용 규정 확대 ⑥ 비용에 관한 규정 A9/B9 정리 ⑦ 운송ㆍ수 출통관 조항에 보안 관련 의무 삽입 등이다. 한계점으로는 CIP 최대담보 의무에 따른 매도인 의 부담 증가, FCA 선적선하증권 발행 시 내륙인도일자와 본선적재일자의 불일치, Incoterms 기계적 개정 필요성 여부, Incoterms 규정 범위의 제한 등을 살펴보았다.
