Attention is focused on the Metaverse platform. Companies have different stances to pursue profit, users to communicate in a non-face-to-face manner, and the government to prepare for the future through messages from the Covid-19. Looking forward to activation. As such, the Metaverse is rapidly emerging as another opportunity for us, but due to the absence of legislation to be applied to the Metaverse platform, it has recently become a place for Digital sex crimes. Exchanging sexual conversations within the platform has become a daily routine, and coercion of similar sexual acts is common. Not only is there no direct physical contact, but stimulating sexual violence is also common following continuous sexual harassment. Therefore, in this study, we focus on preparing legal countermeasures to prevent Digital sex crimes targeting avatars and real users on the Metaverse platform. For this discussion, a brief overview of the Metaverse and Digital sex crimes is provided. And among the bills to respond to Digital sex crimes that have recently been proposed to the National Assembly and are pending, we would like to analyze the limitations of the amendment to the Information and Communications Network Act and present opinions for review.

메타버스 플랫폼에 전 세계의 관심이 집중되고 있는데, 기업에서는 이윤추구를 위해서, 이용자들은 비대면 방식의 교류를 위해서, 정부에 서는 코로나 사태로부터의 교훈을 통해 미래를 대비하기 위해서 등 각 자 입장은 다르지만, 공통적으로 메타버스의 활성화를 기대하고 있는 것이 사실이다. 이렇듯 메타버스는 우리에게 또 다른 기회로 급부상하 고 있으나, 메타버스 플랫폼에 직접적으로 적용될 입법의 부재로 인해 최근 들어 범죄의 온상이 되어가고 있다. 플랫폼 내에서 성적인 대화 를 주고받는 건 일상이 되었고, 유사 성행위 강요도 다반사다. 직접적 인 신체 접촉만 없을 뿐, 지속적인 성적 괴롭힘에 이어 자극적인 성폭 력 역시 비일비재하다. 따라서 본 연구에서는 메타버스 플랫폼에서 아바타와 실제 사용자를 대상으로 한 디지털 성범죄의 방지를 위해 법적인 대응 방안 마련에 비중을 두도록 한다. 이러한 논의를 위해 메타버스와 디지털 성범죄에 대해서 간략하게 개관해보고, 최근 국회에 제안되어 계류 중인 디지털 성범죄 대응 4법 가운데 가장 유의미한 정보통신망법 일부개정법률안 의 한계점 분석 및 검토의견 제시를 하고자 한다.
