Recently, a story behind a profiler's interview that Yoo Young-chul, a rare serial killer, said in the past, "I was scared when my son called me during the crime." As such, it can be seen that the status of "family" can play an important role in suppressing wrong and shameful behavior in person. If so, it can be predicted that this element of "family" can effectively control the "awareness of shame," one of the important influencing factors that actually cause sexual offenders to "impulse to damage electronic tagging." In conclusion, it was confirmed that sex offenders who feel more shame feel the urge to damage their electronic tagging, and criminals who perceive "family pain" positively control the effect of the perception of shame on the impulse to damage electronic tagging. As a result, it can be seen that the more face-to-face the "family pain", the stronger the effect of increasing the impulse to damage the electronic tagging. In order to more effectively and stably carry out the correction process for criminals wearing electronic tagging, it is necessary to emphasize the role of the family as part of the correction process for criminals themselves. It is also expected that the results of this study will be used as basic data to conduct in-depth discussions on the direction of social awareness and treatment that families in the same community will experience so that the criminal's family does not perceive reality only as "pain."

최근 전자발찌를 착용한 상태로 보호 관찰 하에 있던 범죄자가 장치를 훼손한 뒤 또 다시 중범죄를 저지른 사건이 연이어 발생했다. 이와 같은 사건들로 인해 전 자발찌를 훼손하는 행위의 원인은 무엇인지에 대한 다양한 연구가 진행되었다. 선행 연구에 따르면, 성범죄자들이 전자발찌를 훼손하는 행위는 주로 억제 이론 과 저항 이론을 중심으로 설명된다. 그 중에서도 저항 이론을 기반으로 하는 ‘수치심의 인식’이라는 요인은 공통적으로 다수의 연구에서 중요한 영향 요인 인 것으로 확인되었다. 이를 바탕으로 이 연구에서는 전자 감독 제도가 그 특성 상 범죄자가 자신의 가족과 가까이 있다는 점에 착안하여 ‘가족’이라는 요인이 범죄자의 장비 훼손이라는 일탈 행위에 어떠한 영향을 미치는지를 검증하였다. 검증 결과 ‘가족이 자신 때문에 고통스러워 한다는 사실’을 강하게 인식할수록 ‘수치심의 인식’이 전자발찌 훼손 충동에 미치는 영향을 더욱 강화시키는 것으 로 나타났다. 이러한 연구 결과를 통해 전자 감독 제도를 보다 안정적이고 효과 적으로 운영하기 위해서는 범죄자에게 가족의 고통이 그대로 전달되도록 무방비 상태로 방치해선 안 된다는 것을 알 수 있었다. 또한 교정 과정의 일환으로서 그 들의 참회와 성실한 복역을 통해 가족의 고통을 줄일 수 있다는 긍정적인 인식으 로 유도해야 한다는 것을 확인하였다. 또한 향후 전자발찌를 착용하는 범죄자들 의 가족이 현실을 ‘고통’으로만 인식하지 않도록 그들이 겪게 될 사회적 인식 과 처우 등의 개선 방향성에 대해서도 충분히 논의해야 한다는 사실을 확인하였 다. 향후 이 연구가 위와 같은 논의의 활성화를 위한 기초 자료로서 활용되기를 기대한다.
