This study presented the current operation status and problems with the personnel system of the secretariat of local council, and then discussed the development measures for local council. For this, this study analyzed the legal nature of the secretariat of local council that would generally manage and support parliamentary activities of local council, and the appointment of personnel composing the secretariat of local council. The secretariat of local council is a core organization composing the local council. The secretariat of local council generally manages and supports parliamentary activities of local council. In other words, the secretariat is a necessary organization for the operation of local council. However, in case of local council of Korea, the composition and operation as the secretariat for supporting parliamentary activities of local councilors and operating the local council are very insufficient. Especially, even though the expert member system is prescribed as a part for assisting parliamentary activities of local councilors, the problems with the appointment system, personnel management, and expertise of exert members have been continuously brought up. This was pointed out as a factor that would extremely restrict the right to autonomous organization and the right to autonomous administration of local council. The local council has been vitalized again since July 8, 1991 when the city/township/district councils(election on March 26, 1991) and the municipal/provincial councils(election on June 20, 1991) were open. In 30 years from that time when the local autonomy system elected by popular vote is fully carried out, it would be necessary to re-examine if the functions and roles of local council are suitable for the eye level of the people. As the alternatives for changing the secretariat of local council to an independent organization of local council, this thesis presented the guaranteed independence of personnel authority of local council and the operation of the independent job cluster system focusing on professions. And as the alternatives to the personnel system related to the appointment of employees composing the secretariat of local council, the composition of an agency separated from organization and the operation of personnel authority would be realistic.

본 연구는 지방의회 사무기구의 운영과 지방의회 사무기구 인사제도의 문제 점을 제시하고 지방의회의 발전방안을 논하는 것을 주된 목적으로 하였다. 이 를 위해 지방의회 의정활동을 총괄적으로 관리하고 지원하는 지방의회 사무기 구의 법적 성격 및 지방의회 사무기구를 구성하는 직원 임명에 관한 법적 검토 를 시도하였다. 지방의회 사무기구는 지방의회를 구성하는 핵심기관 중 하나이다. 이 사무기 구는 지방의회 의정활동을 총괄적으로 관리하고 지원하는 성격을 가진다. 즉 사무기구는 지방의회 운영에 있어 필요적 기구라 할 것이다. 그러나 우리나라 의 지방의회의 경우 지방의원 의정활동을 지원하고, 지방의회 운영을 위한 사 무관리기구로서의 구성과 운영은 지방자치법상 관련 규정도 몇 개의 조문만 규 정하고 있어 매우 미흡한 실정이다. 특히 지방의회 의원의 의정활동을 보좌하 기 위한 일환으로 전문위원제도를 규정하고 있으나, 전문위원에 대한 임용제도 및 인사관리와 전문성 등에 대해 줄곧 문제 제기되어 왔다. 따라서 본고에서는 지방의회의 자치조직권과 자치행정권을 극도로 제약하는 요인임을 지적하였다. 지방의회가 다시 활기를 띄게 된 것은 1991년 3월 26일 각 시･군･구의회가 같은 해 6월 20일 시･도의회가 선거 후 7월 8일 개원하면서부터다. 그로부터 32년이 된 시점에서 민선 지방자치제가 본격화되고 있는 현재, 지방의회의 기 능과 역할이 우리 국민의 눈높이에 맞는지 재조명할 필요가 있다. 본고에서는 지방의회 사무기구를 명실상부한 지방의회 기구로 독립시킬 수 있는 대안으로 의회인사권 독립 보장과 전문직 중심의 독립직렬제 운영을 제시 하였다. 그리고 지방의회 사무기구를 구성하는 직원 임명 관련한 인사제도 대 안으로는 기관분리형 기관 구성과 인사권 운영이 현실적임을 강조하였다.
