This study aims at the review and improvement on the restraint factors for the people's political participation guaranteed by the Korean constitution. As for the Act on the Parties, the study seeks necessary measures for the political participation of the government servants and school teachers, and of the requirements for the party formations. The current Act on Parties has some regulations confining free national and party's political participation. By this study, some measures for their further political participation would be found through the foreign case study.

이 연구는 헌법에서 보장하고 있는 국민의 참정권 확대와 정당정치 참여 활성화를 위한 제약요인을 검토하고 관련 법 개정 방향을 모색하는 것을 목적으로 한다. 특히 정당법과 관련하여 공무원과 교원의 정치참여, 정당 설립 요건 등을 중심으로 현행법의 문제점과 개정방향을 모색하였다. 우리 정당법은 국민의 정치참여를 규제하고 정당의 자유로운 정치활동을 제한하는 규정들을 가지고 있다. 공무원과 교원의 정당가입을 금지한 규정 이나 수도에 중앙당을 둔 전국정당이 아니면 정당으로 등록할 수 없도록 한 규정 등이 그것이다. 이 연구는 정당법을 중심으로 국민의 참정권을 제한하 는 규정들을 둘러싼 논의들을 검토하고 해외 사례를 정리함으로써 정당정치의 활성화와 국민들의 자유로운 정치 참여를 보장하는 방안을 모색하였다.
