Recently, artificial intelligence (AI) has made its presence felt in criminal justice procedures, and through this, it has reached a point where it is possible to support decision-making with high accuracy without prejudice by using AI system technology in criminal justice procedures. And while AI systems can analyze an accused's risk and help judges make sentencing decisions, the use of AI in criminal justice proceedings can lead to its own inherent bias concerns. Nevertheless, some important social and ethical concerns need to be addressed, namely transparency and consistency. For AI systems to be used effectively to help judges make sentencing decisions and provide accurate assessments of offenders' risks and needs, a number of issues need to be addressed. In other words, we would like to discuss how AI systems should be used in criminal justice procedures. Therefore, the background of the emergence of AI systems necessary for criminal justice procedures, major research trends, and the relationship between criminal justice and artificial intelligence are sought to present the main points of artificial intelligence (AI) in criminal justice procedures.

최근 인공지능(AI)은 형사사법 절차에서 그 존재를 느끼게 하고 있으며, 이를 통해 형사사법 절차상 AI 시스템 기술을 활용하여 편견 없이 높은 정확도로 의사 결정을 내릴 수 있도록 지원이 가능한 시점에 도달하였다. 그리고 AI 시스템은 피고인의 위험을 분석하고 판사가 양형 결정을 내리는 데 도움을 줄 수 있으며, 형사사법 절차에서 AI의 사용은 그 자체의 고유한 편견에 대한 걱정으로 이어질 수 있다. 그럼에도 불구하고 몇 가지 중요한 사회적, 윤리적 관심사, 즉 투명성과 일관성이 제시되어야 할 필요 가 있다. AI 시스템이 판사의 양형 결정을 돕고 범죄자의 위험과 필요에 대한 정확한 평가를 제공하기 위해 효과적으로 사용되기 위해서는 다양한 문제를 해결해야 할 필요가 있다. 즉 형사사법 절차상 AI 시스템이 어떻게 활용되어야 하는지 논의하고자 한다. 따라서 형사사법 절차상 필요한 AI 시스템이 등장한 배경과 주요 연구 동향, 형사사법과 인공지능과의 관계를 모색하여 형사사법 절차상 인공지능(AI)의 주요논점을 제시하고자 한다.
