This study was conducted to suggest a direction for the recently newly attempted youth drug policy in Korea by examining the current situation and domestic policy on drug use among adolescents, which are becoming increasingly serious, and by analyzing the case of the United States. As a result of the study, first, the number of juvenile drug offenders in Korea is rapidly increasing, and recently, the proportion of drug use is higher than that of hemp or psychotropic drugs among drugs, and they are subject to the same criminal punishment-oriented policy as adults. Second, the United States is approaching drug use-related crimes from a problem-solving perspective through treatment, rather than focusing on traditional criminal punishment. Third, the United States has a system that can derive an evidence-based approach through systematic data collection to ensure the effectiveness of criminal justice or therapeutic approaches. Fourth, the United States has established and is operating a centrally controlled drug response system centered on state agencies. Fifth, the United States is focusing on education on drug use prevention in schools. Based on the results of the study, it was suggested that the current juvenile drug offender management system needs to be checked, integrated management at the national level, development and dissemination of prevention education programs, and the need for a change to treatment and recovery-oriented policies.

본 연구는 날로 심각성을 더해가는 청소년 마약류 사용에 관한 실태와 국내 정책을 점검하 고, 미국의 사례를 분석함으로써 최근에 새롭게 시도되고 있는 우리나라 청소년 마약 정책에 대한 방향을 제시하기 위해 수행되었다. 연구결과 첫째, 우리나라의 청소년 마약류 사범이 급격하게 증가하고 있고, 최근에는 마약 류 중 대마나 향정신성의약품 보다 마약 사용의 비중이 높아지고 있으며, 성인과 마찬가지로 형사처벌 위주의 정책을 적용받고 있다. 둘째, 미국은 약물 사용과 관련된 범죄에 대해 기존 전통적인 형사처벌 중심이 아닌 치료를 통한 문제해결적 관점에서 접근하고 있다. 셋째, 미국은 형사사법적이나 치료적 접근의 효과성을 담보하기 위하여 체계적인 데이터 수집을 통하 여 증거에 기반한 접근 방식을 도출할 수 있는 시스템을 갖추고 있다. 넷째, 미국은 국가 기 관을 중심으로 중앙 통제적인 마약 대응 체계를 구축하여 운영하고 있다. 다섯째, 미국은 약물 사용 예방을 학교에서의 교육에 주력하고 있다. 연구결과를 토대로 현재의 청소년 마약류 사범의 관리 체계 점검과 국가차원의 통합적 관리, 예방 교육 프로그램의 개발과 보급, 치료와 회복 중심의 정책으로 전환이 필요함을 제언 하였다.
