It is important to point out that stalking is a process of action, not a one-time act. This study intends to take a comprehensive approach to the improvement of operations to protect victims of stalking. There is a need for a discussion that can realistically protect and support victims of stalking. It aims to try a variety of approaches, such as what the main components are, what is needed, and to what extent the main role and setting of the activity will be considered, focusing on the stalking victim. Since the main direction of the study was focused on victims of stalking, the review of laws was limited to concepts and definitions, and data provided by institutions and data from previous studies were used for data analysis. Considering the purpose of the enactment of the Stalking Punishment Act, the contents and proposals reviewed mainly on the protection of victims of stalking crimes are as follows. First, a victim-centered approach strategy considering the characteristics of the victim is needed. Second, it is necessary to expand the discretion of field police officers. Third, it is necessary to accumulate and manage data on stalking. Fourth, it is necessary to set priorities for dedicated personnel and police activities. Fifth, it is proposed to prepare a follow-up management plan after detection and enforcement.

스토킹은 일회성 행위가 아니라 행동 과정이라는 점이 중요하다. 이 연구는 스토킹의 피해자를 보호 하기 위한 운영의 개선 방안에 대해 포괄적인 접근을 시도하고자 한다. 스토킹 피해자를 보호하고 지원 할 수 있는 현실적 논의가 필요한 상황이다. 스토킹 피해자를 위한 핵심적 구성요소는 무엇인지, 무엇이 필요한 것인지, 활동의 주된 역할과 설정을 어느 수준에서 고려할 것인지 등 다양한 접근을 시도하는 데 목적이 있다. 연구의 주된 방향은 스토킹 피해자를 중점으로 설정하고 있으므로 법령 검토는 개념 및 정의에 국한 하였고, 자료 분석은 기관 제공 자료 및 선행 연구의 자료를 토대로 수행하였다. 스토킹처벌법의 제정 목적을 고려하여 스토킹범죄 피해자에 대한 보호를 중심으로 검토한 내용과 제 언은 다음과 같다. 첫째, 피해자의 특성을 고려한 피해자 중심의 접근 전략이 필요하다. 둘째, 현장 경찰 관의 재량권 확대가 필요하다. 셋째, 스토킹에 대한 자료 축적 및 관리가 필요하다. 넷째, 전담 인력 및 경찰활동에 대한 우선순위 설정이 필요하다. 다섯째, 적발 및 집행 이후의 사후 관리 방안의 마련을 제안한다.
