In the waters of the West Sea Five (5) Islands, citizen control is inevitable for national security and the safety of residents in the Islands. Persistent compensation and support is also necessary for their pains, however. The legislation relating to the Islands areas has two aspects. One is to support the residents of the Islands who are suffering from military threats due to the division of South and North and the geographical location, and the other is to regulate their daily life and production activities. This study analyzes the feasibility of the current legislation and its amendment currently pending in the National Assembly for lasting effective support for the residents. By analyzing the acts and precedents relating to the duties of civil servants in the control of illegal fishing in the waters of the Islands, it was pointed out that the interests of those who have obtained fishing licenses are not merely rreflective interests.

서해 5도 수역에서는 국가 안보와 서해 5도에 거주하는 국민들의 안전보장을 위하여 주민들 에 대한 통제가 불가피하다. 다만 서해5도 주민들에 대한 보상과 지원을 지속하는 것이 필요하 다. 서해 5도 지역에 대한 법제는 크게 두 측면이 있다. 하나는 남북 분단 현실과 특수한 지리적 여건상 북한의 군사적 위협으로 피해를 입고 있는 서해 5도 지역주민을 지원하는 것이고, 다른 하나는 서해 5도 주민의 생활 및 생산활동을 규제하는 것이다. 본 연구에서는 서해 5도 지역 지원의 근거가 되는 현행 법제와 현재 국회에 계류 중인 개정안 의 타당성을 분석함으로써 지속적이고 실효적인 지원의 근거를 마련할 수 있도록 하였다. 또한 서해 5도에서 공무원의 불법조업 단속의무와 관련하여 관련 법령과 판례 분석을 통하여 어업허 가를 받은 자들의 이익이 반사적 이익에 그치지 않음을 지적하였다.
