Digital transformation has the characteristics of coexisting positive aspects(productivity･efficiency improvement, etc.) and negative aspects (misuse of personal information, increasing social discrimination, etc.). Thus, governments need to understand the ambivalence of digital transformation and establish a digital transformation policy in the form of both a digital transformation promotion policy and a responding policy for counter-functioning. However, the dysfunction of digital transformation has already become a reality centering on artificial intelligence technology and is causing technical and social problems, governments lack understanding of this problems and are passive in setting the response direction. Therefore, this study reviewed the current status of responding policies for counter-functioning of digital transformation by focusing on artificial intelligence technology, which is the core technology of digital transformation. In addition, I analyzed whether it is legally justifiable for the government to respond to the dysfunctional functions of digital transformation. Furthermore, this study analyzed and proposed policy instruments(professional ethical approach, establishment of a certification system, establishment of personal rights, and direct administrative regulation) that governments can consider practically when establishing policies to respond to digital transformation.

디지털 전환은 긍정적 측면(생산성, 효율성 향상 등)과 부정적 측면(개인정보 오남용, 사회적 차별 증대 등) 이 공존하는 특성을 보유하고 있다. 따라서 정부는 디지털 전환의 양면성을 이해하여 디지털 전환 촉진 정책과 역 기능 대응 정책을 함께 마련하는 형태로 디지털 전환 정책을 수립할 필요가 있다. 그러나 디지털 전환의 역기능은 이미 인공지능 기술을 중심으로 현실화되어 기술적‧사회적 문제를 발생시키고 있으나 정부는 이에 대한 이해가 부 족하고, 대응 방향 설정에도 소극적인 상황이다. 이에 본 연구는 디지털 전환의 핵심기술인 인공지능 기술에 초점을 맞추어 역기능 대응 정책 현황을 검토하였고, 정부가 디지털 전환 역기능에 대응하는 것이 타당한지 분석하였다. 아 울러 원론적 대응 방향이 아닌 정부가 실질적으로 고려할 수 있는 디지털 전환 역기능 대응 정책 수단 4가지(전문 가 윤리적 접근, 인증체계 구축, 개인적 권리 설정, 직접적 행정 규제)를 규제 수준별로 제시 및 분석하였다.
