Recent technological advances in neuroscience offer a novel way for parents to nurture their children: altering brain activation to improve cognitive functions. Parental use and state regulation of cognitive enhancement will inevitably cause tensions between parent, child, and state. These tensions stem from three different but fundamentally related causes, namely minors’ incompetency in making decisions about their own welfare, parental auton- omy to make decisions about the upbringing of their minor children, and the state’s interests in protecting minors’ well-being. However, these tensions are notwithout precedents. The courts have frequently struggled to set the boundary of parental autonomy and to balance parents’ rights, children’s interests, and state’s interests, and have accumulated extensive precedents in various contexts. This article reviews previous US court decisions in select contexts analogous to cognitive enhancement—medical intervention, education, and mandatory vaccination—and analyzes their implications for the use of cognitive enhancement on minors. This article will provide a useful guide for policymakers and researchers to identify and analyze issues regarding cognitive enhancement and to develop sound policies to ensure responsible use of this novel technology.

최근 신경 과학의 기술 발달은 부모가 자녀를 양육하는 데 있어서 새 로운 방법을 제시한다. 자녀의 뇌 발달에 개입하여 그들의 인지 기능을 향상시키려는 것이다. 부모가 자녀를 교육 양육할 때 자녀의 인지적 향 상을 사용하는 데 대하여 국가의 규제가 있을 경우, 부모, 자녀, 그리고 국가 사이에 긴장 관계가 불가피하게 발생하게 된다. 이러한 갈등은 세 가지의 다르지만, 근본적으로 연관된 원인들로부터 시작된다. 이른바, 자신의 복지에 관해 결정할 수 없는 미성년자의 무능력, 자녀 양육에 관 한 결정을 내리는 부모의 자녀양육권, 그리고 미성년자를 보호하기 위한 국가의 공익적 관심이다. 신경과학 기술의 발전이 유발하는 이러한 긴장 관계는 새로운 형태이지만, 이에 대하여 시사점을 주는 미국의 판례들이 존재한다. 미국의 법정은 부모가 가진 자녀양육권의 범위를 정하고 부모 의 권리, 그리고 자녀와 국가의 관심 사이에서 균형 잡기 위해 계속 고 심해온 결과, 다양한 사례들로부터 선례들이 축적되어왔다. 본고는 인지 능력 향상과 유사한 사례인 의료 개입, 교육, 그리고 예방접종 의무화에 관한 미국의 법정 판례를 검토하고, 미성년자에게 사용되는 인지적 향상 에 대한 법적 함의를 분석한다. 이를 통하여 인지적 향상과 관련된 이슈 를 확인하고 분석함으로써, 이 새로운 기술을 책임 있게 사용하여 건전 하고 합당한 정책을 수립할 수 있도록 정책 입안자와 연구자에게 유용한 지침을 제공할 것으로 기대한다.
