오키나와 무국적 아동의 실상과 국적법개정 - 포스트제국의 ‘포섭’의 경계에서 -

The Reality of Stateless Children in Okinawa and the Revision of the Nationality Act : At the boundaries of the Post-Empire’s “inclusion”

This paper explored the reason children of foreign residents in Japan became stateless and their living conditions by focusing on stateless children who appeared after the U.S. returned Okinawa to Japan in 1972. And the paper also intends to present the logic of “inclusion” and “exclusion” of the Post-Empire’s boundary. To this end, this paper looked at the discussion on the amendment of the Nationality Law surrounding Jus Sanguinis proposed as a solution to the problem of statelessness and the requirements for Okinawan stateless children to acquire a nationality. The main reason many children became stateless is their American fathers did not support their Japanese wives and children. The neglect of stateless children left them in a blind spot for human rights, and considering this reality, the International Social Assistance Okinawa suggested that the country revise the Nationality Act to adopt Jus Sanguinis of bilineal descent. Meanwhile, advocating gender equality under the Constitution of Japan, the revision of the Nationality Act to adopt Jus Sanguinis was promoted in mainland Japan. Under the 1985 revision, the stateless under the age of 20 may acquire Japanese nationality but those born before 1965 cannot be granted Japanese nationality even if their mother was a Japanese citizen. Deliberately, the Japanese government did not specify the year 1947 in the revised law because they did not want Koreans and Taiwanese who were under colonial rule to acquire Japanese citizenship. In revising the Nationality Act to “include” stateless children who were once marginalized in Okinawa in a nation-state, Japan set the boundaries between “inclusion” and “exclusion” with the colonial perspective of the Japanese Empire in the past.

본 논문은 1972년에 오키나와가 일본으로 반환되면서 드러난 무국적 아동에 초 점에 맞추고 무국적 아동의 발생 요인과 무국적 아동의 생활 실태를 살펴보았다. 무국적 아동 문제를 해결하는 방법으로 제안된 부모양계혈통주의로의 국적법개정 의 논의와 오키나와 무국적 아동이 국적을 취득할 수 있는 자격요건에 주목하여 포스트제국의 경계인에 대한 ‘포섭’과 ‘배제’의 논리를 제시해보고자 했다. 오키나와의 무국적 아동이 발생하는 근본요인은 미국인 아버지가 일본인 아내와 자녀를 부양하지 않은 점에 있다. 무국적 아동의 방치는 아동이 인권의 사각지대 에 놓이는 결과를 낳았고, 그러한 실태에 주목한 오키나와 국제복지상담소는 부모 양계혈통주의로 국적법을 개정하도록 제안하였다. 이와 달리 일본 본토에서는 일 본국헌법의 남녀평등을 내세우며 부모양계혈통주의로의 국적법개정이 추진되었다. 개정된 국적법을 보면 무국적 아동이 일본 국적을 취득할 수 있는 나이는 20세 미만으로 같은 일본인 어머니에게서 태어났어도 1965년 이전에 출생한 자는 일본 국적을 취득할 수가 없다. 일본 정부가 1947년을 의식적으로 설정하지 않는 이유는 식민지배를 받았던 조선인과 대만인이 일본 국적을 취득하는 것을 우려했기 때문이다. 오키나와의 주변에 머물렀던 무국적 아동을 국민국가로 ‘포섭’하는 국적법 개정에 있어 일본은 과거 일본제국의 ‘식민지적’ 시선으로 ‘포섭’과 ‘배제’라는 경계를 설정했다.
