The purpose of this study is to diagnose the reality of treating female prisoners, derive problems in the treatment of female prisoners regarding human rights and the prohibition of discrimination, and suggest ways to improve the Punishment Execution Act in accordance with international standards. The background of this study is grounded on the basic idea that female prisoners should be treated differently according to women’s physical and psychological characteristics. Based on that, this researcher intends to understand the characteristics of female crimes and female prisoners, diagnose the current status of female prisoners in Korea’s corrections, discover problems by analyzing the aspects of the current law precisely, and devise ways to improve the law on that by considering the tasks to be done in the reality of our corrections. Yet, the overall direction of this study is to set the direction for enhancing our law that slightly falls behind international standards such as the UN’s Minimum Standards and Rules for Detainees in terms of human rights and the prohibition of discrimination and Gender Perspective. Concerning the methods of research, literature review and statistical data analysis have been done mainly to figure out the problems that female prisoners face and solutions for them. With the findings, this author has learned that it is needed to correct and edify female prisoners grounded on respect for humans while treating them and also institutionalize and revise the law in consideration of female prisoners and their children. Lastly, this researcher emphasizes that in any case, female prisoners should be respected in terms of human rights and the prohibition of discrimination and Gender Perspective. It is expected that this study will contribute to improving the treatment of female prisoners in the 21st century.

이 연구의 목적은 여성수형자 처우의 현실을 진단하고 인권과 차별금지 차원에서 여성수형자 처우의 문제점을 도출하여 국제 규준에 맞는 형집행법의 개선방안을 제시함에 있다. 연구의 배경 을 보면 여성의 신체적ㆍ심리적 특성에 따라 여성수형자 처우도 달라져야만 한다는 기본사고 위에 여성범죄의 특징과 여성수형 자의 특징을 파악하고 한국교정에서 여성수형자의 실태를 진단 하고 현행법의 모습을 정확히 분석한 뒤 문제점을 발견하고 우 리의 교정현실의 과제가 무엇인지를 생각하면서 이에 대한 법적 개선방안을 마련하고자 한다. 다만 연구전체의 방향은 UN 피구 금자최저기준규칙과 같은 국제규준에 조금은 못 미치는 우리법 의 내용을 인권과 차별금지 및 성인지적관점에서 개선방향을 설 정하고자 한다. 연구방법으로는 주로 문헌연구와 통계자료분석 을 통해 여성수형자가 갖고 있는 문제점과 개선방안을 검토하였다. 연구결과 여성수형자처우도 인간존중의 교정ㆍ교화가 이루어 져야 한다는 점, 성인지적관점에서 제ㆍ개정이 이루어져야 한다 는 것을 알게 되었다. 끝으로 어떠한 경우에도 여성수형자의 인 권과 차별금지는 존중되어야 한다는 것을 강조한다. 이 연구가 21세기 여성수형자처우의 발전을 위하여 일조가 될 것으로 기대 한다.
