Fourteen members of Korean National Assembly including Congressman Eung-Chun Cho proposed Revision Bill of Article 98-2 in National Assembly Act on June 14th in 2022. ㅅhe gist of the bill is to reinforce the control over the administrative legislation not by the National Assembly but by its standing committee. However, some commentators say that the bill is unconstitutional violating the separation of power doctrine provided in Korean Constitution. Can it be so? This paper aims at examining whether the bill is unconstitutional. To achieve the aim, I will look into the changes of Article 98-2 in National Assembly Act at first, and analyze the background and main contents of the current bill. After that, I will examine whether the bill is unconstitutional violating the separation of power doctrine provided in Korean Constitution. In addition, I will also look into the concerned systems in Germany and U.S.A. in the perspective of comparative law.

2022년 6월 14일에 대표발의인인 조응천 의원을 포함한 14인의 국회의원들은 국회법 제98조의2에 대한 개정 법안을 발의하였다. 국회가 아니라 상임위원회가 행정입법에 대한 통제 주체가 되어 보다 강화된 행정입법권을 행사한다는 것이 법안의 골자이다. 이 개정 법안에 대해 일부에서 삼권분립원칙 위반 등을 이유로 한 위헌론이 제기되고 있다. 과연 국회 상임위원회의 강화된 행정입법 통제는 위헌 일까? 본 연구는 이번의 국회법 제98조의2 개정 법안이 일부의 주장대로 위헌인지 여부를 검토함으로써 이를 헌법적 측면에서 분석하는 것을 연구목적으로 삼는다. 이러한 연구목적을 달성하기 위해 우선 우리나라에서 국회의 행정부 행정입법권 통제제도의 변천과정에 대해 살펴보고, 이번에 조응천 의원이 대표발의한 국회법 일부개정안의 내용을 제안 배경과 주요 내용을 중심으로 분석해보며, 국회법 개정 안의 위헌 여부를 행정부의 행정입법 제정권을 침해해 삼권분립원칙 위반인지의 여부와 법원의 행정입법에 대한 사법심사권을 침해해 삼권분립원칙 위반인지의 여부를 중심으로 판단해본다. 또한 독일, 영국, 미국 등 선진 외국의 행정입법 통제 제도들과의 비교를 통해 결론부에서는 행정입법 통제의 바람직한 개선방안에 대해 생각해본다.
