As the legislation is a normative means that forms the future, the legislation of child should be basically established suitable for child’s interests by considering the specificity of child. Despite many legislations related to child and low birthrate measures, there are no procedures for objectively discussing the elements that could violate child’s interests in the legislative process by analyzing the impact of law on child in advance. Even though it is difficult to expect the legislative completion that could accomplish all the best interests in the perspective of child, it is still possible to analyze the elements that could impact child in advance through the procedural means of legislative method, principle, or legislative process, and also to seek for alternatives that could reduce the hazardous possibility. Thus, this thesis presented the necessity of the impact analysis of legislative bills on child through the consideration of child-centered perspective on legislation, and the necessity to establish the drafting checklist based on main principles such as non-discrimination against child and best interests of child in the ｢Child Welfare Act｣ and UN’s Convention on the Rights of the Child, in order to materialize the interest balancing of child for drafting review. Moreover, this study also aimed to consider the necessity to legislatively realize the child-centered perspective by mentioning the problems with legislative method in each area based on universal birth registration and health rights of child.

입법은 미래를 형성하는 규범적 수단으로서 아동에 대한 입법은 아동이란 대상 적 특수성을 고려하여 아동의 이익에 적합하게 마련될 것을 기본요소로 한다. 수많 은 저출생 대책 및 아동 관련 입법이 존재하지만, 아동에게 영향을 미칠 수 있는 법률의 영향을 사전에 분석하여 입법과정에서 아동침익적 요소가 객관적으로 논의 될 수 있는 절차는 마련되어 있지 않은 실정이다. 아동의 관점에서 최선의 이익이 모두 관철될 수 있는 입법적 완결성을 기대할 수 없을지라도 입법방식이나 원칙 그리고 입법과정의 절차적 수단들을 통해 아동에게 영향을 미칠 수 있는 요소를 사전에 분석하고 그 위해가능성을 낮추는 대안적 모색은 얼마든지 가능할 수 있다. 따라서 논문에서는 입법에 있어 아동중심의 관점에 대한 고찰을 통해 법률안에 대 한 아동영향분석의 필요성을 제시하고, 입안심사시 아동의 이익형량을 구체화 할 수 있도록 ｢아동복지법｣ 및 UN 아동권리협약상 아동 비차별 및 아동 최우선 이익 등의 주요원칙에 기반한 입안체크리스트 마련의 필요성을 제시하였다. 나아가 아동의 보편적 출생등록 및 건강권 등에 기반해 분야별 입법방식의 문제점을 언급하여, 입법론적으로 아동중심의 관점이 구현되어야 할 필요성 역시 고찰하고자 하였다.
