Recently, we are experiencing a variety of complex sharing economy issues that need to be addressed. In this paper, I analyzed issues and suggested the need for Basic Act on Sharing Economy. Most of the basic acts are declarative, it is pointed out that the effectiveness of law enforcement may be insufficient. In addition, since sharing economy activities are taking place in very diverse fields, there is an opinion that it is appropriate to regulate them in applicable individual laws. Nevertheless, it is necessary to enact Basic Act on Sharing Economy to clarify the definition of the sharing economy and to develop a master plan on the basis of sharing economy policy for all state agencies to implemented. Basic Act on Sharing Economy can act as a framework that can launch sustainable national sharing economy policy.

최근 우리나라는 공간 공유, 모빌리티 공유, 물품 공유, 정보ㆍ서비스 공유 등 매우 다양 한 형태로 공유경제 활동이 도입되어 활용되고 있으나, 법적으로 공유경제에 대한 명확한 개념 정의가 마련되어 있지 않다. 이에 따라 공유경제 참여자와 해당 영역에서 사업을 영 위하고 있는 기존 사업자, 미래의 잠재적 공유경제 참여자 모두에게 공유경제와 관련한 불 확실성과 불안이 존재하고 있다. 이에 본 논문은 코로나-19로 잠시 멈추었던 일상적인 경제활동이 재개되면 향후 공유경 제 활동이 다시 활발히 진행될 것으로 예상되는 만큼 공유경제 활동의 확산에 적절히 대응 하고 기존 사업자와의 이해관계 충돌로 인한 사회적 혼란 등을 줄이기 위해 공유경제의 개념을 법적으로 명확히 정의하고 관련 정책의 방향과 원칙, 기준 등을 규정하는 기본법 형 태의 법안 제정이 필요함을 제시하였다.
