In the era of the 4th industrial revolution, the importance of data is being emphasized not only in industry but also in the public and social fields, and in Korea, various policies are being implemented to promote data distribution and utilization. However, the domestic data trading market is still in its infancy, and clear norms have not been established to effectively regulate the quality of data to be traded, actions taken at the transaction stage between transaction entities, and various violations of interests that may occur after the transaction. In particular, market participants are experiencing confusion due to the lack of regulations related to data ownership or copyright. The world is now entering the data economy era. Not only people and objects, but also information about all objects such as factories, cities, and the natural environment is being recorded as digital data. This data serves as a basis for decision-making in the process of individual choice, corporate product and service production, and national policy establishment. Data is the oil that drives society and the economy, and is the blood that flows inside. Now, the important thing is to effectively establish data governance and establish a legislative system for data rights protection. It is a part of data legislation to accommodate the paradigm shift towards the data age in a short period of time and to use the exogenous crisis as an opportunity for growth. The data legislative policy is also significant in order to increase the chances of success of the Korean version of the New Deal, which is based on data dams and artificial intelligence. In particular, it is urgent to establish a data policy promotion system, that is, data governance. In January 2020, the amendment bill to the ‘3rd Data Act’ was passed through the National Assembly’s resolution as to which policy to pursue regarding data rights protection. And with the enactment of the Data Industry Framework Act and the Industrial Digital Transformation Act in December 2021, legal issues regarding data rights protection are being raised. The remaining tasks are expected to develop the concept of data ownership and the discussion of intellectual property rights protection of data. And it is necessary to study how to establish and effectively manage data governance regarding who will lead data governance. Therefore, this study aims to define the concept of data and establish a protection system for the protection of rights. This study conducted a study on the protection of copyright law and data rights protection under the recently revised Unfair Competition Prevention Act as a proprietary approach to data rights protection and an intellectual property right approach. carried out. Furthermore, directions for data governance establishment and efficient management methods were also reviewed.

4차 산업혁명 시대를 맞이하여 산업뿐만 아니라 공공․사회 영역에 이르기까지 데이터의 중요성이 부각되고 있으며, 우리나라에서도 데이터 유통 및 활용을 촉진하기 위하여 다양한 정책을 실시하고 있다. 그러나 아직 국내 데이터 거래 시장은 형성 초기 단계로, 거래되는 데이터의 품 질이나 거래 주체 상호 간의 거래 단계에서의 조치 및 거래 이후 발생 할 수 있는 다양한 법익 침해 상황을 효과적으로 규율할 수 있는 명확 한 규범이 설정되지 못한 상황이며, 특히 데이터에 대한 소유권이나 저 작권과 관련한 규정 미비로 인하여 시장 참여자들이 혼란을 겪고 있다. 세계는 지금 데이터 경제시대를 진입하고 있다. 사람과 사물뿐만 아 니라 공장, 도시, 자연환경 등 모든 대상의 정보들이 디지털 데이터로 기록되고 있다. 이 데이터는 개인의 선택, 기업의 제품 서비스 생산, 국 가의 정책 수립 과정에서 의사결정의 근거가 되고 있다. 데이터는 사회 와 경제를 작동시키는 원유이자 그 내부에 흐르는 혈액과도 같다. 이제 중요한 것은 데이터 거버넌스를 효과적으로 구축하는 것과 데이 터의 권리보호에 관한 입법체계를 정립하는 것이다. 짧은 기간에 데이터 시대로의 패러다임 변화를 수용하고, 외생적인 위기를 성장의 기회로 활 용하기 위한 데이터 입법의 일환이다. 데이터 댐, 인공지능을 핵심으로 하는 한국판 뉴딜의 성공 가능성을 높이기 위해서도 데이터 입법정책의 의미가 크다. 특히 데이터 정책 추진체계 즉, 데이터 거버넌스(data governance) 의 구축이 시급하다. 데이터의 권리보호에 관한 어떤 정책을 추진할 것 인지는 2020년 1월 ‘데이터 3법’의 개정 법률안이 국회의 의결을 거치면서 일단락되었다. 그리고 2021년 12월 데이터 산업기본법과 산업디 지털전환법이 제정되면서 데이터의 권리보호에 관한 법적 쟁점이 제기 되고 있다. 이제 남은 과제는 데이터의 소유권에 관한 개념 정립과 데이 터의 지식재산권법적 보호에 관한 논의가 전개될 것으로 전망된다. 그리 고 누가 어떻게 데이터 거버넌스를 이끌어 나갈 것이냐에 관한 데이터 거버넌스의 구축 및 효율적 관리방안에 관한 연구가 필요하다. 따라서 본 연구는 데이터의 개념 정의와 권리보호에 관한 보호체계를 정립하고자 데이터의 권리보호에 관한 소유권적 접근과 지식재산권법적 접근으로서 저작권법 보호 및 최근 개정된 부정경쟁방지법상의 데이터 권리보호에 관한 연구를 수행하였다. 나아가 데이터 거버넌스 구축에 관 한 방향제시 및 효율적 관리방안도 아울러 검토하였다.
