Nowadays, gays and lesbians claim to establish an anti-discrimination act as the development of democracy enhances individual freedom and human rights, and postmodern culture emphasizes the value of diversity. However, a dispute arises because the provision of the discrimination act includes the sexual orientation and gender identity that designates homosexuality as one of the reasons for discrimination. The anti-discrimination act tries to impose compulsory punishments on people who do not regard homosexuality as normal sexual orientation and sexual behavior, while social consensus about homosexuality is not made. The act needs to reflect both individual freedom and the tradition of social ethics but Korean society today does not accept homosexuality as normal. Furthermore, the teachings of the Bible clearly forbid homosexuality since the Bible indicates that homosexuality is a serious sin. Hence, Korean churches have to protect the right of faithful expression against homosexuality and accept gays and lesbians simultaneously with showing discernment. Christians need to follow the law of love rather than the law of society and thus churches have to carry out the ministry of protecting the basic human rights of gays and lesbians and providing them with the education of edification.

오늘날 개인의 자유와 인권을 강조하는 민주주의 시민의식 제고 및 개인의 주관성 과 다양성의 가치를 강조하는 포스트모더니즘과 대중문화의 확산으로 인하여 동성애 자들은 적극적으로 목소리를 내고 있으며, 2006년 권고 법안이 제출된 차별금지법은 그들의 목소리를 담는 중요한 도구가 되었다. 그러나 차별금지법에 명시된 차별금지 사유에 포함된 성적 지향과 성별 정체성이 동성애를 전제하기 때문에 이를 둘러싼 논 쟁이 끊이지 않는다. 평등의 원칙에 근거한 개인의 권리와 사회 윤리적 전통 사이의 이견(異見)으로 인하여 동성애를 인정하는 사회적 합의가 부재한 상태에서 차별금지 법은 동성애를 정상적인 성적 지향으로 인정하지 않는 이들에게 강제적 처벌을 가함 으로써 문제가 된다. 또한, 차별금지법이 차별 사유로 포함한 동성애에 대하여 기독교 신앙의 근간인 성경은 명확하게 이를 죄로 규정하며 금지하고 있다. 따라서 한국교회 는 동성애를 거부하는 신앙적 표현의 자유를 수호하는 한편, 동성애자들을 용납하는 구속적 분별력을 발휘해야 하는 두 가지 과제를 동시에 안고 있다. 그러한 과제를 수 행하는 과정에서 과도한 교회중심주의 및 전적으로 교회의 공적 책임을 강조하는 양 극단을 경계하는 한편, 하나님의 사랑과 은혜라는 신앙적 토대를 기반으로 동성애는 거부하되, 동성애자들의 입장에서 불편함이 없이 그들을 포용할 수 있도록 그들의 인 권 보호, 교화, 교육 등의 사역을 전개해야 할 것이다.
