Article 9 of the Act on the Fairness of Franchise Transactions prohibits the franchisor from providing false or exaggerated information to prospective franchisees or franchisees. This prohibition of false and exaggerated information was newly established on August 13, 2013. And 2017. 4. 18. A new provision for punitive damage compensation has been established that allows the franchisee to be held liable for damages not exceeding three times the amount of damage incurred by the franchisee in the event of an act of providing false, exaggerated, or deceptive information. As the punitive damages system was introduced in the Franchise Business Act, the number of complaints and dispute requests related to false or exaggerated information by the franchise headquarters increased rapidly to the Fair Trade Commission and its affiliated dispute mediation council. Accordingly, the necessity to standardize the normal damage caused by the franchisor's act of providing false or exaggerated information has also increased. In this study, we try to provide practical guidelines for claiming damages due to the act of providing false or exaggerated information by analyzing the judgment sentences in these cases. In conclusion, the general trend of precedents is that “costs incurred to sign a franchise contract and open a store”, that is, opening costs, were regarded as ordinary damages caused by the headquarters’ act of providing false or exaggerated information. But, it denied the causal relationship between the tort of the franchisee and the damage in the case of 'costs or losses incurred in the process of operating the franchise after the franchise contract was concluded'. In addition, by acknowledging the negligence of the franchisee, only a portion of the total opening cost was recognized as the amount of damage. According to the attitude of these precedents, the franchisee bears all the damage caused by the erroneous information of the franchisee headquarters. However, the purpose of the franchise agreement is for the franchisee to ‘open and operate a franchise store’, therefore, both establishment and operation costs should be interpreted as being included in the scope of damages normally incurred by the rules of experience due to the act of providing false or exaggerated information by the franchisor.

가맹사업거래의 공정화에 관한 법률 제9조는 “허위⋅과장된 정보제공 등의 금지”라는 표제 하에 가맹본부가 가맹희망자나 가맹점사업자에게 정보를 제공함에 있어서 허위⋅과장의 정보 제공행위(사실과 다르게 정보를 제공하거나 사실을 부풀려 정보를 제공하는 행위)"와 기만적인 정보제공행위(계약의 체결⋅유지에 중대한 영향을 미치는 사실을 은폐하거나 축소하는 방법으 로 정보를 제공하는 행위)를 금지하고 있다. 이러한 허위과장정보 금지 규정은 2013. 8. 13. 신설되었는데, 2017. 4. 18. 가맹본부가 허위⋅ 과장 또는 기만적인 정보제공행위 등을 한 경우(같은 법 제9조제1항)에는 가맹점사업자에게 발 생한 손해의 3배를 넘지 아니하는 범위에서 배상책임을 지도록 하는 징벌적 손해배상 규정도 같이 신설되었다(같은 법 제37조의2 제2항). 이처럼 가맹사업법에 징벌적 손해배상제도가 도입 되면서 공정거래위원회와 산하 분쟁조정협의회에 가맹본사의 허위과장정보 행위와 관련한 신 고와 분쟁신청이 급증하였다. 따라서 가맹본부의 허위⋅과장정보제공행위로 인해 발생하는 통 상손해를 정형화할 필요성 또한 증가하였는바, 이 연구에서는 가맹사업법에 징벌적 손해배상제 도가 도입되기 전후로, 가맹본부의 허위⋅과장정보제공으로 인한 손해배상청구사건의 판결문 들을 분석하여 최근 급증하는 허위⋅과장의 정보제공행위로 인한 손해배상청구에 대한 실무적 지침을 제공하려 한다. 결론적으로, 판례의 대체적 경향은, “가맹계약을 체결하고 점포를 개설하기 위하여 지출한 비용’, 즉 개업비용을 본부의 허위⋅과장정보제공행위로 인한 통상손해로 보았고, ‘가맹계약이 체결된 이후 가맹점을 운영하는 과정에서 발생한 비용이나 손실’은 가맹본사의 불법행위와 손해 간의 인과 관계를 부인하였다. 또한 손해발생에 있어 가맹점사업자의 과실을 인정하여 전체 개업비용 중의 일부만을 손해액으로 인정하였는바, 이러한 판례의 태도에 의하면 가맹본사의 잘못된 정보에 대한 피해를 고스란히 가맹점사업자가 떠안는 셈이다. 그러나 가맹계약의 목적은 가맹점사업자가 ‘가맹점을 개설하고 운영’을 하는데 있으므로, 개설비용과 운영비용 모두 ‘가맹 본부의 허위⋅과장 정보제공행위로 인해 경험칙상 통상 발생하는 것으로 생각되는 범위의 손해’ 에 포함된다고 해석해야 할 것이다.
