The review of the legality of major administrative decisions is one of the important procedural links essential for the administrative organs to make major administrative deci sions, which is conducive to improving the legality of major administrative decisions, preventing and avoiding the occurrence of illegal decision-making behaviors, and thus safeguarding public interests. At present, the legislation involving the standard of review of the legality of major administrative decisions is scattered in administrative regulations, local regulations, local government regulations and other administrative normative docu ments. The highest legislation on the standard of reviewing the legality of major administ rative decisions is the Interim Regulations on Major Administrative Decision-Making Proc edures promulgated by the State Council. China's central and local administrative organs at all levels are paying more and more attention to the improvement of the legality revie w standards of major administrative decisions, and the credibility of major administrative decisions has been improved year by year. However, there are still many problems in the legislation of the legality review standards of major administrative decisions, such as the lack of unified legislation of the legality review standards of major administrative decisions, insufficient systematization of the legality review standards of major administra tive decisions, and insufficient provisions in the public aspect of the legality review stand ards of major administrative decisions. Therefore, it should unify the legislation on the review standard of the legality of major administrative decisions, strengthen the systemati zation of the review standard of the legality of major administrative decisions, and improve the legislation on the disclosure of the review standard of the legality of major adminis trative decisions.

重大行政决策合法性审查是行政机关作出重大行政决策必不可少的重要程序环节之一, 有利 于提高重大行政决策的合法性, 防止和避免违法的决策行为的发生, 进而维护公共利益。 目前涉及 重大行政决策合法性审查标准的立法散见于行政法规、 地方性法规、 地方政府规章以及其他行政 规范性文件, 有关重大行政决策合法性审查标准的最高立法为国务院颁布的《重大行政决策程序暂 行条例》。 中国中央和地方各级行政机关愈发重视重大行政决策合法性审查标准的完善, 重大行政 决策的公信力也逐年得以提升。 但是重大行政决策合法性审查标准的建设中仍存在缺少重大行政 决策合法性审查标准的统一立法、 重大行政决策合法性审查标准的体系化不足、 重大行政决策合 法性审查标准公开方面的规定不足等诸多问题。 因而应对重大行政决策合法性审查标准进行统一 立法、 加强重大行政决策合法性审查标准的体系化建设、 完善重大行政决策合法性审查标准公开 方面的立法。

중대한 행정결책의 합법적 심사는 행정기관이 중대한 행정결책을 내리는 중요한 절차중의 하나이며 중대한 행정결책의 합법성을 제고하고 위법적인 결책행위의 발생 을 방지하고 피면하며 공공이익을 수호하는데 유리하다. 현재 중대한 행정결책의 합 법적 심사기준은 행정법규, 지방성법규, 지방정부규장 및 기타 행정규범성문건에 분 산적으로 규정되어 있는데 최고입법은 국무원에서 제정한 <중대한 행정결책 절차 임시 시행조례>이다. 중국의 중앙과 지방의 각급 행정기관은 중대한 행정결책의 합 법적 심사기준의 보완을 날따라 중요시하고 있고 따라서 중대한 행정결책의 공신력 도 높아가고 있다. 하지만 중대한 행정결책의 합법적 심사기준의 입법중에는 여전히 중대한 행정결책의 심사기준의 통일입법이 부족하고 중대한 행정결책의 합법적 심사 기준의 체계화가 미흡하고 중대한 행정결책의 심사기준의 공개에 관한 규정이 보완 되지 않은 등 여러가지 문제점이존재하고 있다. 때문에 응당 중대한 행정결책의 합법 적 심사기준에 관한 통일입법을 제정하여야 하고 중대한 행정결책의 심사기준의 체 계화 건설을 강화하여야 하며 또한 중대한 행정결책의 심사기준의 공개에 관한 입법 을 보완하여야 한다.
