YouTube is an online personal broadcasting service with virtually no barriers to entry and allows users to become consumers and producers who create, post, and enjoy desired content. The YouTube spaces can be classified into the public, private, and the user’s own secret spaces. As public and private spaces, where free expression could potentially be limited because of the content’s publicized nature, the YouTube space is deeply related to issues regarding freedom of expression. There are cases where YouTube content is deleted by YouTube platforms at home and abroad, and censorship or deletion of YouTube content can restrict freedom of expression and the right to know. Censorship is further classified into constitutional and private. In general, restrictions on freedom of expression are a problem in constitutional censorship, but there is room for issues of freedom of expression in private censorship as well. YouTube may censor or delete content of its own volition or at the request of administrative agencies. Superficially, YouTube deletes content, but in truth, YouTube’s censorship would constitute a restriction on freedom of expression if administrative agencies censor the content. Even when content is deleted for YouTube’s own purposes, the opacity of YouTube’s censorship standards could pose a problem. Before using the YouTube platform, the user agrees to YouTube’s policy. Such a policy potentially violates freedom of expression should this consent be obligatory (i.e., necessary to becoming a YouTube user). Because YouTube features various content by free participation and expression, it is considered appropriate to activate the user’s autonomous filtering rather than regulate each content on YouTube. When YouTube deletes content, it seems necessary to improve the transparency of its censorship by clearly identifying and publicly explaining the YouTube standards being applied and what is being violated by the deleted content. Through transparent processes, users would better understand YouTube’s content deletion criteria. Thus, it is expected that YouTube content can be filtered autonomously at the user level by creating and uploading filtered content in the future, considering these criteria.

유튜브는 이용자 누구나 소비자이자 생산자가 되어 직접 원하는 콘텐 츠를 창작하고 게시하거나 감상할 수 있는 인터넷개인방송이다. 유튜브 공간은 공적 공간, 사적 공간, 이용자 자신만의 은밀한 공간으로 분류될 수 있다. 공적 공간 및 사적 공간으로서의 유튜브 공간에서는 콘텐츠가 공개되기 때문에 자유로운 표현에 한계가 있을 수 있고 표현의 자유의 문제와 관련이 깊다. 국내외적으로 유튜브 플랫폼에 의하여 유튜브 콘텐 츠가 삭제되는 사례들이 있고 유튜브 콘텐츠의 삭제는 표현의 자유와 알 권리를 제한할 수 있다. 검열은 헌법상 검열과 사적 검열로 분류할 수 있 다. 일반적으로 표현의 자유의 제한은 헌법상 검열에서 문제가 되지만 사 적 검열에서도 표현의 자유의 문제가 제기될 여지가 있다. 유튜브 플랫폼 은 자체적으로 유튜브 콘텐츠를 삭제하기도 하고 행정기관이나 이용자의 요청에 의하여 콘텐츠를 삭제하기도 한다. 표면적으로는 유튜브 플랫폼이 콘텐츠를 삭제하지만 사실상 행정기관의 요청에 따라 콘텐츠를 삭제하는 경우라면 표현의 자유의 제한에 해당할 수 있다. 유튜브 플랫폼의 자체적 인 목적에 의하여 콘텐츠를 삭제하는 경우라도 유튜브의 삭제 기준의 불 투명성이 문제가 된다. 유튜브 플랫폼을 이용하기 전에 이용자는 유튜브 정책에 동의한 후 이용하는데, 유튜브를 이용하기 위한 불가피한 동의인 경우라면 표현의 자유의 침해에 해당할 수 있다고 보인다. 유튜브는 자유로운 참여 및 자유로운 표현에 의한 다양한 콘텐츠를 특징으로 하는 만 큼 유튜브 콘텐츠에 대하여 유튜브 플랫폼에 의하여 규제하기보다 이용 자 스스로 자신이 창작한 콘텐츠를 검토하는 자율적인 필터링을 활성화 하는 것이 적절할 것으로 생각된다. 유튜브 플랫폼에 의하여 콘텐츠가 삭 제되는 경우에 유튜브 플랫폼이 어떠한 기준을 적용하고 콘텐츠의 어떠 한 부분에 문제가 있음을 유튜브 채널 측에 명확하게 통지하고 공개적으 로 게시하여 삭제의 투명성을 제고하는 것이 필요하다고 보인다. 이러한 투명한 절차를 통해 이용자는 콘텐츠 삭제 기준을 구체적으로 확인할 수 있고 유튜브 플랫폼의 삭제 기준을 고려하여 향후 콘텐츠를 창작하고 업 로드함으로써 콘텐츠의 창작 단계에서부터 자율적으로 유튜브 콘텐츠를 필터링할 수 있을 것으로 보인다.
