This study gives an overview of constitutional review on customary international law. According to Korean Constitution, it is persuasive to understand that customary international law has same legal effect as domestic statutes enacted by Korean legislature, so constitutional review on customary international law also should be carried out through ‘constitutional review of statutes upon request’ procedure(Korean Constitutional Court Act §41(1)) or ‘constitutional review-type of constitutional complaint’ procedure(Korean Constitutional Court Act §68(2)). In these procedures, following characteristics of customary international law should be considered enough. (1) It can be proved that the customary international law at issue does not exist. (2) It is hard to apply the standard of review requiring the presence of legislator, such as proportionality test or equality test. (3) Even a decision of unconstitutionality cannot abolish the customary international law at issue. Korean district courts carried out kinds of constitutional review on customary international law last year, but it is doubtful that these judgments considered above characteristics enough. Federal Constitutional Court of Germany has ‘verification of customary international law’ procedure, and makes a decision on whether the customary international law at issue exists and is a part of German federal law, etc. If it is proved to be unconstitutional, the court might make a decision that the customary international law at issue is not a part of German federal law. On the other hand, Constitutional Court of Italy has accepted ‘counter-limit doctrine.’ According to this doctrine, if the customary international law at issue is inconsistent with basic principles of constitutional order and inviolable fundamental rights, it cannot enter into Italian domestic legal order. The followings are suggestions of constitutional review on customary international law of Korean Constitutional Court. This procedure can be composed of 2 steps; (1) verifying existence and content of the customary international law at issue, (2) determining whether the customary international law at issue can enter into domestic legal order or not. And in (2) step, whether the customary international law at issue is inconsistent with Korean Constitution can be tested. 3 types of decisions can be made; ‘non-existence(corresponding to dismissal)’, ‘existence and incorporation(corresponding to constitutional)’, ‘existence but non-incorporation(corresponding to unconstitutional).’

이 글에서는 그동안 헌법학계에서 잘 다루어지지 않았던 국제관습법에 대한 위헌 심사 전반에 관하여 시론적 연구를 시도해 보았다. 국제관습법은 국제적으로 형성된 일반적 관행에 법적 확신이 부여된 것으로서, 조 약과 함께 국제법원의 양대산맥을 이룬다. 우리나라의 현행 헌법상 국제관습법은 형 식적 의미의 법률과 동일한 효력을 갖는 것으로 봄이 타당하므로, 이에 대한 위헌심 사 역시 위헌법률심판이나 규범통제형 헌법소원심판에 의함이 타당할 것이다. 다만 구체적인 위헌심사에 있어서는 형식적 의미의 법률에 대한 것과 비교하여, 문제되는 규범이 부존재할 여지가 존재하고, 입법자의 존재를 전제로 하는 과잉금지 원칙, 평등원칙 등을 통한 구체적 심사가 어려우며, 위헌판단을 하더라도 일반적인 효력을 상실시킬 수 없는 등의 특성이 있으므로, 이를 충분히 고려할 필요가 있다. 우리나라 헌법재판소에서는 아직 국제관습법에 대한 위헌심사를 수행한 바 없고, 최 근 하급심 판결에서 이를 행한 바 있으나 위와 같은 특성을 충분히 반영하였는지에 는 의문이 있다. 독일에서는 국제관습법 인증절차를 마련하고 있어, 법원의 제청을 통해 연방헌법 재판소에서 국제관습법의 존부와 연방법의 구성부분인지 여부 등이 판단되고 있다. 그 과정에서 문제되는 국제관습법 자체가 존재하기는 하나 기본법에 저촉된다는 이유로 연방법의 구성부분이 아니라는 판단이 내려질 가능성이 있다. 이탈리아의 경우, 문제되는 국제관습법이 헌법질서의 기본원칙 및 불가침의 기본권과 모순되는 경우 국내법 질서로 편입되지 못한다는 ‘대항한계’ 법리를 채택한 헌법재판소 결정이 행 해진 바 있다. 이를 종합해 볼 때, 국제관습법에 대한 위헌심사의 구체적 절차를 (1) 국제관습법 의 존재 및 내용 확인, (2) 국내법으로의 편입여부 판단으로 구성하고, (2) 단계에서 우리나라 헌법에 위반되는지, 즉 헌법상 기본원칙 및 제도보장/기본권보장의 취지에 저촉되는지 여부에 관한 심사를 행하는 방식을 고안해 볼 수 있을 것이다. 심사 결 과 문제되는 내용의 국제관습법이 존재하지 않는 것으로 확인되면 ‘부존재 취지의 결정’을, 존재하는 것으로 확인된 국제관습법이 헌법에 위반되지 않으면 ‘국내법으로 편입되어 있다는 취지의 결정’을, 헌법에 위반되면 ‘국내법으로 편입되어 있지 않다 는 취지의 결정’을 하는 방식이다. ‘각하’, ‘합헌’, ‘위헌’ 결정의 의미를 위와 같이 새길 수도 있을 것이고, 국제관습법의 편입통제에 특유한 변형결정 형태를 도입할 수도 있을 것이다.
