The purpose of this study is to contribute to the theoretical foundation for Korean police disciplinary system and to suggest practical implications for development of future system. In the early 2000s, the police disciplinary system focused on auditing officer's misconducts and punishing them strictly. However, recently some changes have occurred on the police disciplinary system. The changed systems seek to enhance the fairness of disciplinary process and easier acceptance by disciplined officers. The major changes in the system are as follows: ① Rationalization of the level of disciplinary action ② Mandatory participation and expansion of external personnel to the disciplinary committee ③ Guarantee of the right to defend of audited officers ④ Reinforcement of the objectivity and fairness of disciplinary administration through the Citizens Committee. In this study, following five improvements were suggested as development of the police disciplinary system. ① Integration of disciplinary committee ② Decentralization and specialization of disciplinary process ③ Substantial guarantee of the right to defend of audited officers ④ Improving police officers' awareness of police disciplinary action ⑤ A study on the fairness and strictness of disciplinary action.

이 연구에서는 경찰 징계제도를 이론적으로 고찰하는 한편, 최근 경찰 징계제도의 변화에 살펴본다. 이를 통해 경찰 징계제도에 관한 이해를 제고함과 동시에, 향후 경찰 징계제도 발전을 위한 제언을 도출하고자 한다. 2000년대 초반, 경찰 징계제도가 적발 과 엄정한 처벌에 주안점을 두었다면 최근 경찰 징계제도의 변화는 징계의 공정성과 수용성 강화에 초점을 두었다. 최근 경찰 징계제도의 주요 변화로 ① 경찰의 징계양정 을 합리화 ② 징계위원회에 외부인사 참여 강화 ③ 징계대상자의 방어권 보장 ④ 시민 감찰위원회를 통한 징계행정의 객관성과 공정성 확보 등을 들 수 있다. 이러한 개선에 도 불구하고 경찰 징계행정에 관한 데이터의 공개는 여전히 미흡한 수준에 머무르고 있다. 이 연구에서는 종합적 논의를 통해 경찰 징계제도 발전을 위해 개선 또는 연구되 어야 할 과제로 ① 징계위원회의 통합 ② 징계절차의 분업화와 전문화 ③ 실질적인 징 계대상자의 방어권 보장 ④ 경찰징계에 대한 현장 경찰관의 인식 개선 ⑤ 징계의 공정 성과 엄격성에 관한 연구 등을 제안하였다.
