The most effective means of dealing with unauthorized parking in an individual’s parking space is the self-help right of the real estate possessor (Article 209). Both the right to defend against those acts unjustly depriving him of his possession or to remove the disturbance of and the right to recapture it are applicable. In the latter case, the key is the interpretation of the word “immediate” in paragraph 2 of the same article. The author suggests ‘within 12 hours’, in case of Unauthorized parking monitoring system ‘within 6 hours’ after parking as a tentative guide. Measures to prevent the movement of vehicles parked without permission do not belong to the content of self-help rights. Towing costs shall be deemed to be chargeable by management of affairs or tort. The towing company will be able to retain the towed vehicle until the towing fee is paid. In addition, the parking fee without permission must be returned as unjust enrichment, and the parking fee paid by the victim should be compensated as damages due to tort. It is also determined that the victim is to compensate for the extra time it takes to find another parking lot as damages due to tort.

사인의 주차공간에서의 무단주차에 대처하는 가장 실효적인 수단은 부동산점유자 의 자력구제권(제209조)이다. 자력방어권과 자력탈환권 둘 다 문제될 수 있는데, 후자 의 경우 핵심은 제2항의 “즉시”의 해석이다. 필자는 일응의 기준으로서 주차후 12시간, 무단주차 감시 시스템이 있는 경우 6시간 내를 제시하였다. 무단주차된 차량 이동을 저지하는 조치는 자력구제권의 내용에 속하지 않는다고 할 것이다. 견인비용은 사무관 리 또는 불법행위에 기하여 청구할 수 있다고 본다. 견인회사는 의뢰인에 대한 견인비 용청구권을 담보하기 위해 견인된 차량에 대한 유치권을 행사할 수 있을 것이다. 이외 에도 무단주차자는 주차비 상당을 부당이득으로 반환하여야 하며, 피해자가 지출한 주 차비용은 불법행위로 인한 손해로서 배상하여야 한다고 본다. 또한 피해자가 다른 주 차장소를 찾는 데 허비한 시간에 대해서도 불법행위로 인한 손해로서 배상하여야 한다 고 판단된다.
