The international position of cannabis is evolving as new medical effects of cannabis are continually found thanks to scientific advancements. The WHO’s Expert Committee on Drug Dependence explained the medical effects of cannabis, and the UN Commission on Narcotic Drugs (UNCND) voted to remove cannabis from the schedule of prohibited substances in accordance to WHO’s proposal. In light of this, the purpose of this research is to examine the background of the UNCND’s shift in position on cannabis and the revision of the legal system related to cannabis regulation in major countries, with the goal of identifying meaningful implications and countermeasures for South Korean cannabis policies and regulations. Cannabis is initially looked at from a taxonomic and biological standpoint in this study. After examining cannabis from a variety of angles, it was determined that the future path of international cannabis legislation is shifting toward the regulation usage of cannabis. In Korea, the use of cannabis for medical purposes has begun, and various methods of using cannabis are being studied as part of efforts to lower the threshold of cannabis research for academic purposes. Because the majority of Koreans still have a negative perception of cannabis, social acceptance must come before cannabis use. A free forum for public debate on various cannabis-related topics causes people to look at cannabis from different angles, which can build social trust in cannabis’ legal use.

불법 마약의 대명사로 알려져 온 대마의 국제적 위상이 달라져가고 있다. 과학의 발전으로 인하여 대마의 새로운 의료적 효과가 계속해서 발견되었기 때문이다. WHO의 약물의존성 전문가 위원회(Expert Committee on Drug Dependence)는 2018년 제 41차 회의에서 대마가 가진 의료 적 효과를 설명하였고, WHO의 의견에 따라 UN 마약위원회(the Commission on Narcotic Drugs) 는 통제물질 목록에서 대마를 재분류하기로 결의하였다. 이러한 배경 하에서 본 연구는 국제사 회 대마규제의 총체적 권한을 갖고 있는 국제기구인 UNCND의 대마에 대한 입장 변화의 배경과 주요 국가의 대마규제 관련 법제 동향을 살펴보고 이에 대한 국내적 시사점 및 대응과제를 모색 해 보는 것을 목적으로 한다. 먼저 대마의 과학적, 법률적 분류와 함께 대마의 효능 및 사용에 대해 고찰하고, WHO 및 UN 마약위원회를 비롯한 국제기구의 대마관련 국제규범의 변화를 위한 논의 과정 및 결과를 분석하였다. 이를 통해 대마의 변화된 위상과 향후 대마관련 국제적 입법 방향이 대마의 규제적 이용으로 흐르고 있음을 확인하였다. 이러한 흐름은 대마합법화 논의 과정을 거쳐 합법화를 이루었거나, 현재 논의 중인 주요 국가들의 대마관련 규제 동향에서도 역시 확인할 수 있었다. 우리나라의 경우 대마규제법인 『마약류 관리에 관한 법률』을 중심으로 의료용 목적의 대마사용이 허용되며, 학술적 목적의 대마 연구의 문턱을 낮추는 등 대마의 의료 적 효용을 과학적으로 규명하고, 그 결과를 국민생활건강에 활용하려는 준비를 하고 있음을 확 인하였다. 아직까지 대마에 대한 부정적인 인식이 더 큰 우리나라의 경우 대마의 사용에 있어서 사회적 합의가 먼저 선행되어야 한다. 다양한 대마관련 다양한 정보를 널리 알리고 다양한 시각에서 대마를 바라보는 공론의 장을 통해, 대마의 위험성을 정확히 규제하고 통제함으로써 대마 의 유용성을 국민건강을 위해 사용할 수 있다는 사회적 신뢰를 구축한 후에 한국의 실정에 맞는 규제적 대마이용 정책이 논의되어야 할 것이다.
