The emergence and rapid spread of e-cigarettes have brought unprecedented challenges and problems to the traditional anti-smoking movement. China is the inventor and largest producer of e-cigarettes, issues related to e-cigarettes combined with people’s right to health have become the focus of society in China. However, at this stage, the theoretical research related to e-cigarette is in the initial stage, there is no institutional legal system, and there are various difficulties in the specific legal practice. In view of this situation, this paper carries out the Legalization of e-cigarettes systematically by exploring new theoretical methods related to e-cigarette from the perspective of people’s right to life and health, and introduced the system development status and management model of e-cigarette. In addition puting forward realizable development direction from the perspective of institutional terms by analyzing the legal difficulties by e-cigarette at this stage, and discussing various experiences in legal practice, it aims to improve the legalization process of e-cigarettes. We look forward to the healthy development of the e-cigarette market by supplementing the legalization of e-cigarette.

전자담배의 출현과 급속한 확산은 인류의 전통적인 의미의 금연운동에 유례 없는 도전과 문제점들을 가져다 주고 있다. 중국은 전자담배의 발명국 및 최대 생산국으로서 최근 전자담배와 관련한 문제들이 국민들의 건강권과 더불어 사 회적 이슈로 떠오르고 있으며, 다양한 문제점들과 사건들이 발생하고 있다. 하 지만 현 단계에서 전자담배와 관련한 이론연구가 초기 단계에 머물러 있고, 제도적으로 법적 체계가 구비되지 않아 구체적인 법 실무에서 여러 가지 어려움 들이 발생하고 있다. 이러한 상황에 비추어 본문은 국민의 생명권과 건강권 차원에서 전자담배와 관련한 새로운 이론적 접근을 모색하고, 전자담배의 제도 발전상황과 관리모형 을 소개하였다. 또한 현 단계에서 전자담배가 직면한 법적 어려움을 분석하고 제도적 측면에서 실현 가능한 발전방향을 제시하며, 법 실무에서의 다양한 경험 축적에 대해 논의함으로서 전자담배의 법치화를 체계적으로 지향하고자 한다. 전자담배 법치화의 보완을 통해 전자담배 시장의 건강하게 발전을 기대해 본다.
