Overrepresentation of legal profession in parliament is widespread in most countries. One of the reasons of this phenomenon is the expectation that members who have regal background are more qualified to undertake the lawmaking business. The purpose of this study is to prove this expectation. The result of this analysis is that there are no differences in sponsor of the bill and success of the bills among the members of legal background and other members. This result weakens the justification of dominance of legal profession in Parliament. Meanwile, members with legal backgrounds are more successful in passage of the bills related with legal trainings. Representational imbalance of Parliament is not desirable in the perspective of democratic recruitment.

법조인 출신 국회의원의 과다대표 현상은 우리나라 국회뿐만 아니라 주요국 의회에서도 발견되는 일반적인 현상이다. 이는 입법기관인 의회의 특성상 법조인 경력이 의정활동의 전문성에 도움이 될 것이라는 정당과 유권자의 기대를 반영한다. 이 논문은 제19대 국회를 대상으로 법조인 출신 의원의 입법활동이 기타 의원들과 차별성을 보이는지를 분석한 연 구이다. 분석결과 법안 발의건수와 법안가결율 등 법조인 출신 의원의 입법활동은 다른 의 원들의 입법활동과 차별성이 없는 것으로 나타났다. 이 같은 분석결과는 국회에서 법조인 직군의 과다대표 현상에 대한 명분을 약화시킨다. 다만 법조인 양성과정 등을 통해 법조인 출신 의원이 전문적 지식과 정보를 가질 것으로 기대되는 법안의 경우 법조인 출신 의원이 발의한 법안의 입법성공율이 높았다. 국민의 대표기관인 국회에 특정 전문직군이 과다대표 되는 현상은 국회의 대표성 측면에서도 바람직하지 않을 수 있다.
