Human life by the progress of the times has changed so much. As a result, our society is becoming more diverse and specialized unlike in the past, and in the process, there have been large and small conflicts. This situation has constantly demanded that human beings, who are social and relational beings, solve the problem of conflict, and the resolution was largely done by law, not by morality. However, despite the moral approach that we have learned through education, the law controls our lives more than morality, which solves the problems of conflict. Also, as the logic of the law rules our lives, human relations have transformed into a contractual rather than moral aspect, and the only solution to conflict over these relationships is the law. This article examines whether the problem of conflict in human life cannot be resolved from a moral point of view. In other words, not only does it form more human relationships on the balance of law and morality, but it also tries to solve the problems of conflict morally. Therefore, based on Kant's position, this article seeks to minimize the error of legal moralism and legal positivism on the distinction between the two, not the dichotomy of law and morality. This will soon reveal more clearly that law as the efficiency of domination and morality as the justification of domination are complementary to each other.

시대적 진보에 의한 인간의 삶은 매우 많은 변화를 가져왔다. 그에 따라 우리 사회는 과거와 달리 보다 다원화되고 전문화되었으며, 그 과정에서 크고 작은 갈등과 충돌의 모습 을 보이고 있다. 이런 상황은 사회적이고 관계적 존재인 인간에게 끊임없이 갈등의 문제에 대한 해결을 요구해왔고, 그 해결은 대개 도덕이 아닌 법에 의해 이루어졌다. 하지만 우리 가 교육을 통해 배운 갈등과 충돌의 해결방법은 우선적으로 도덕적인 접근임에도 불구하 고, 도덕보다는 법이 우리의 삶을 더 많이 지배하고 있으며, 이 법을 통해 갈등과 충돌의 문제를 해결하고 있다. 또한 법의 논리가 우리의 삶을 지배하면서, 인간관계는 도덕적이 아니라 계약적인 양상으로 변모하였고, 이런 관계 위에서의 갈등과 충돌의 유일한 해결책 은 법일 수밖에 없다. 이 글은 인간의 삶에서 발생하는 갈등의 문제를 도덕의 관점에서 해 소할 수 없는지에 대해 고찰하는 것이다. 즉, 법의 편향이 아닌 법과 도덕의 균형적 관점 위에서 보다 인간적 관계를 형성할 뿐만 아니라 갈등과 충돌의 문제를 도덕적으로 해결하 고자 하는 데 있다. 따라서 이 글은 칸트의 입장을 토대로 법과 도덕의 이분법적인 분리가 아닌 이 양자의 구별 위에서 법도덕주의와 법실증주의의 오류를 최소화해보고자 한다. 이 는 곧 지배의 효율성으로서의 법과 지배의 정당성으로서의 도덕이 상호 보완적 관계임을 보다 선명하게 드러낼 것이다.
