The number of teenagers working in our society has increased. However, the overall working situation related to youth jobs is precarious. Youth labor is a so-called “part-time job” and is often maltreated as simple labor. For working teenagers to enjoy their legitimate rights as workers, it is imperative to clarify adolescents' definition and scope and investigate the concept of discrimination. When the two premises are met, a transparent system of youth labor can be established, and effective labor inspection measures can be systematically established based on that. It is essential to provide labor law education for employers who employ adolescents and prepare measures for protecting youth labor rights through preventive labor inspection administration. In sum, it would be an appropriate way to improve the labor rights of youth to prevent discrimination by clarifying adolescents' definitions, unifying regulations of related ministries based on this, and establishing labor inspection systems centered on preventive administration.

현재 우리사회는 일하는 청소년들이 많아졌지만 청소년들의 일자리 전반에 걸 쳐 그 실태가 취약한 경우가 많다. 청소년 노동은 일명 ‘알바’로 불리며 단순노 동으로 취급되어 부당한 대우를 받는 경우가 빈번하다. 일하는 청소년이 근로자로서의 정당한 권리를 향유하기 위해서는 청소년 개념 과 범위의 명확화 및 차별개념에 대한 규명이 필요하다. 이 두 가지 전제가 충 족됨으로써 청소년 노동에 관한 명확한 제도체계가 구축될 수 있고, 이를 근거 로 실효성 있는 근로감독 방안 역시 체계적으로 정립될 수 있을 것이다. 청소년 고용 사업주를 대상으로 노동관계법 관련 교육 실시, 사전예방적 근로 감독행정을 통하여 청소년들의 노동권익이 보호될 수 있는 방안 마련이 중요하 다. 즉 청소년 개념의 명확화, 이를 바탕으로 한 관련 부처들의 규정 일원화, 예방 행정 중심의 근로감독 체계구축을 통해 차별을 미연에 방지하는 것은 청소년의 노동권익 향상을 위한 적합한 방안이 될 것이다.
