Recently, advanced technology countries are strengthening their systems to prevent the outflow of core national technologies overseas in the process of promoting existing technological innovation policies. In order to advance the domestic industry and expand national wealth, policy development and promotion to enhance industrial technology protection capabilities as well as existing technology innovation policies have become important tasks. In this study, from the perspective of new institutionalism, major policies for enhancing industrial technology protection capabilities in both Korea and Japan were compared. As a result of the analysis, it was confirmed that some factors differed according to industrial technology protection policies of Korea and Japan. It also explained the background of this difference by referring to path dependence and institutional stratification from a new institutional perspective. The results of this survey are of great significance in that they were the only domestic industrial technology protection policy that suggested, compared, and analyzed factors affecting the formation of related systems, ultimately drawing implications for enhancing domestic industrial technology protection capabilities.

최근 기술 선진국들의 경우 기존의 기술혁신 정책을 추진함에 있어 기술개발 못지 않게 국가 전략물자 및 주요 기술의 해외 유출 방지를 위한 제도를 강화하고 있다. 바야흐로 자국 산업을 육성하고 국부를 확대하기 위해서는 기존의 기술혁신정책 뿐만 아니라 산업기술 보호 역량 제고 를 위한 정책 개발·실행 또한 중요한 과제로 인식하게 된 것이다. 본 연구에서는 이러한 상황 인식하에 우리나라와 일본의 산업기술 보호 역량 제고를 위한 주 요 정책을 신제도주의적 관점에서 비교·분석해 봄으로써 양국의 산업기술 보호 정책 전개에 대 한 경험적 일반화를 모색해 봄은 물론 나아가 국내 산업기술 보호 정책 개선에 필요한 시사점 도 출을 주된 연구목적으로 수행하였다. 분석 결과 우리나라와 일본의 산업기술 보호 정책에 따른 요인에 있어 일부 차이가 발생함을 확인해 볼 수 있었으며, 이러한 차이가 발생한 배경을 신제도 주의적 관점에서 경로의존성과 제도적 중층성을 들어 설명하였다. 이와 같은 연구 결과는 국내 산업기술 보호 정책 분야에서는 거의 유일하게 관련 제도의 형성에 영향을 주는 요인을 제시하 고 이를 비교·분석함으로써 궁극적으로는 국내 산업기술 보호 역량 제고를 위한 시사점을 도출 하였다는 점에서 큰 의의를 가진다고 할 수 있다.
