Currently, competency of a police criminal investigator is hotly debated right after the prosecution reform which was temporarily ended in 2020. The current prosecution reform allows the police to investigate criminal case independently and finish without prosecutor’s instruction, which means that the police is in full responsibility of criminal investigation with a few exceptional cases which belong to prosecutor’s exclusive power. This current change generated a new concern on the competency of police investigation in terms of effectiveness, efficacy of criminal investigation, and human rights issues. In this vein, a few issues worth in-depth discussion. The first question is the meaning of investigation competency in current Korea settings. This paper argues that competency of investigation in current situation must be reviewed from two perspectives. Foremost, the competency of a criminal investigator must be evaluated in terms of not only cognitive ability but investigator’s personality. Second, the competency of police investigation must be considered in terms of procedural justice from the people’s point of view. The former suggests that the selective examination changed in a way to test candidates’ personality. However, it is not easy to determine ‘pass or fail’ based on the aptitude test. Thus, the aptitude test must be used in the process whether a current police officer applying for a detective is suitable as a criminal investigator as it is not a proper test to determine eliminate applicants for a new police officer. Regarding the second procedural justice issue, this paper argues that police recruits must be more diversified allowing direct entry of middle rank investigators in order to ensure people’s trust on the fairness of police investigation in additions to internal systematic change in the organization of police investigation.

현시점에서 수사경찰의 역량강화를 위한 가장 큰 과제는 수사 인력의 보강이다. 그 러나 국민적 공감대가 형성되어 있는지는 의문이다. 수사경찰에 대한 국민의 신뢰 부족 이 부족한 인력현상을 더욱 악화시키는 것은 아닌지 검토할 필요가 있다. 최근 화두가 되고 있는 경찰수사의 역량 강화를 위해서는 수사전문성과 수사의 공 정성이 지향점이 되어야 하며, 그 평가는 국민의 관점에서 검토될 필요가 있다. 수사의 전문성 확보를 위해서 가장 시급한 것은 전문 수사 인력의 확충인데 그 과정에서 개방 성, 다양성을 확보할 필요가 있다. 수사의 공정성 확보는 수사관 개인의 업무태도 측면 과 수사절차에 대한 제도적 통제 관점에서 검토할 수 있다. 전자와 관련하여 수사관의 적성, 업무 및 성격태도가 중요한데, 상대방의 이야기를 충분히 경청하며 공감할 줄 아 는 태도를 필요로 하므로 수사관 선발 및 교육에 있어서 이와 같은 점을 고려할 필요가 있다. 그러나 선결조건으로 업무 부담이 해결되어야 하므로 수사 인력 확보도 수사의 공정성 확보측면에서 중요하다. 수사관 채용에 대한 구체적 개선방안으로서, 시보 순경 중 예비 수사 경과자를 선발하는 방안, 순경으로 수사관을 별도 선발하는 방안, 경력경쟁채용을 통해 경사 계급을 선발하는 방안으로 나누어 장･단점을 검토하였다. 이 중 경사급 수사관을 별도 선발하 는 방식이 우수 수사관 확보라는 측면에서 가장 바람직한 것으로 보인다. 또한, 기존 경 찰관 중 부서장 추천을 통해 일정 수의 수사경과자를 선발하는 부서장 추천제도를 확 대할 필요가 있다. 마지막으로, 교육 및 평가에 있어서 집단교육과 OJT교육을 병행하 고, 수사공정성을 평가할 수 있는 제도마련이 필요하며, 장기적인 관점에서 사법경찰관 리의 구분을 폐지하고 수사관 등급제를 도입하여 수사성과에 있어서 역할 중심의 평가와 보상이 이루어지도록 개선할 필요가 있다.
