This paper provides an overview of the history and basic contents of the US Community Reinvestment Act. of 1977, which mandates investment and loan within the business area of large commercial banks, and the revision(upgrade) process. In the case of the United States, it was found that the regional reinvestment law not only alleviates the phenomenon of financial exclusion within the region, but the content of the law is strengthened as the financial system at the national level is reorganized into marketism, that is, neoliberalism. In other words, considering that the regional level of financial exclusion will intensify as the entire U.S. financial system is reorganized in a laissez-faire direction, the Regional Reinvestment Act further strengthens the regulation and examination of large commercial banks, while simultaneously strengthening the regional reinvestment performance of large commercial banks. has been upgraded in the direction of extensive disclosure to the civil society of the region. In Korea, where local financial exclusion is gradually aggravating as local bank funds flow out of the region, it is urgently necessary to institutionalize such regional reinvestment laws in the form of laws or ordinances at the national or regional(community) level.

본고는 대형 상업은행들의 영업 지역 내 투융자를 의무화하는 미국 지역재투자법의 역사와 기본 내용, 그리고 그 수정 과정을 개괄적으로 살펴보았다. 미국의 경우, 이러한 지역재투자법을 통해 지역 내 금융배제 현상을 완화하고 있을 뿐만 아니라, 그 법의 내용이 일국 차원의 금융시 스템이 시장주의화될수록, 즉 신자유주의적으로 재편될수록 더욱 강화되고 있음을 알 수 있었 다. 바꿔 말해, 미국 전체의 금융시스템이 자유방임적인 방향으로 재편될수록 지역 차원의 금융 배제 현상이 더 심화될 것을 고려하여, 지역재투자법은 대형 상업은행에 대한 규제와 심사를 더 욱 강화하고 동시에 대형 상업은행들의 지역재투자 실적을 해당 지역의 시민사회에 대대적으로 공개하여 시민사회가 직접 대형 상업은행을 통제할 수 있도록 하는 방향으로 업그레이드되어 왔음을 밝혀내었다. 지역 내 은행 자금들이 지역 밖으로 유출되면서 지역 내 금융배제 현상이 점차 심화되고 있는 우리나라에서도, 이와 같은 지역재투자법이 일국 차원 또는 지역 차원에서 법 또는 조례의 형태로 시급히 제도화되어야 할 필요가 있다.
