The purpose of this study is to analyze whether ordinances enacted by metropolitan and provincial offices of education nationwide to support the Maul education community contain necessary contents to function according to the purpose of legislation and to reveal characteristics and improvement tasks. As a result of analyzing 15 ordinances, it was found that cooperation, win-win, and community value orientation between schools and communities are well revealed as general discussions, but the content needs to be strengthened in detail. It was confirmed that the roles or methods of participation of villagers and community education activists were not presented, and that administrative cooperation between the Office of Education and local governments should be presented in more detail. It was also confirmed that there was a lack of regulations for the establishment and operation of a continuous and stable maul education community support organization, and responsibility for financial support or financing methods should be specified. In addition, it was found that most of the ordinances require improvement in similar areas. Research is needed to confirm the effectiveness of future ordinances.

본 연구의 목적은 전국의 시·도교육청에서 제정한 마을교육공동체 지원 조례의 특징을 확인하고 개선사항을 도출하는 것이다. 마을교육공동체 지원을 위한 상위 법률이 제정되지 않은 상황에서 각 지역은 조례를 제정하여 지역별 교육실천을 위한 근거로 활용하고 있다. 자치법규 정보시스템을 통해 15개 시·도교육청이 제정한 조례를 확보한 후 규범과 실행 의 틀을 기준으로 조례의 내용을 비교·분석하였다. 분석 결과 각 지역별 조례의 목적에는 총론으로서 학교와 마을의 협력, 상생, 공동체적 가치 지향성이 잘 드러나지만 각론에 대 한 내용 보강이 필요하다는 점을 확인하였다. 또한 마을 주민, 마을교육활동가의 역할이나 주체적 참여 방식 등을 제시하지 못하고 있음을 확인하였고, 교육청과 지자체의 행정 협력 이 필수임에도 불구하고 상당수의 조례에는 이와 관련된 내용이 구체적이지 못하다는 점 을 밝혔다. 그리고 마을교육공동체 지원 조직의 설치·운영에 대한 내용 규정이 부족하다 는 점, 재정 지원의 책무나 재원조달 방법 등을 구체화해야 한다는 점, 실무 수준의 민· 관·학 거버넌스 구축 조항이 보강되어야 한다는 점, 대부분의 조례가 대동소이하여 지역 의 여건과 맥락을 반영하지 못하고 있다는 점도 확인하였다. 이를 바탕으로 향후 조례의 실효성을 확인하는 연구가 필요함을 제안하였다.
