Many advanced countries in modern society recognize the limitations of in-facility treatment in terms of social return, crime suppression, and financial management of prisoners, and actively research and introduce social treatment systems as an alternative. However, it is still difficult to say that Korea's social treatment system has reached a sufficiently effective and stable stage, and it is true that it lacks in terms of perception, administration, and effectiveness. In this regard, Nordic countries such as Sweden, Finland, and Norway are seeing their crime rates decline to a fairly high level every year, and they are so-called advanced correctional countries that pay a lot of attention to safety and security and operate related policies. However, little research has been conducted on this due to the problem of linguistic barriers and institutional differences. In particular, studies on treatment in facilities such as prisons and detention systems have often been conducted, but few studies have been conducted on probation or rehabilitation protection systems. Therefore, this study aims to lay the foundation for introducing their institutional advantages, effective operation methods, and examples to Korea in the future and finding alternatives to institutional improvement by examining the current status and operation of social treatment systems in Nordic countries.

현대사회의 많은 선진국에서는 범죄자의 사회복귀와 범죄억제 및 재정운영의 측면에서 시설내처우의 한계를 인정하고 이에 대 한 대안으로 사회내처우 제도를 적극적으로 연구하고 도입하고 있는 추세이며, 이에 관해 우리나라에서도 보호관찰법 제정, 전 자감시제도, 수강명령과 사회봉사명령의 시행 등을 통해 사회내 처우에 관한 제도를 운영하고 있다. 그러나, 아직까지 우리나라의 사회내처우 제도는 충분히 효과 적이고 안정적인 단계에 도달했다고 보기는 어려우며, 인식과 행 정, 효과성 등의 측면에서 부족한 점이 보여지고 있는 것이 사실 이다. 이에 관해 스웨덴, 핀란드, 노르웨이 등 북유럽국가들은 해마 다 범죄율이 상당히 높은 수준으로 감소하고 있으며, 안전과 치 안에 많은 관심을 갖고 관련 정책을 선구적으로 운영하는 소위 교정 선진국으로, 이들의 제도와 정책을 파악하고 연구하는 것은 범죄억제정책 운영에 많은 도움이 되는 것으로 여겨진다. 하지만, 북유럽국가의 언어적 장벽과 제도적 상이함의 문제로 국내에서는 이에 대한 연구가 거의 수행되지 못하였다. 특히 교 도소나 구금제도와 같은 시설내처우에 관한 연구는 종종 수행되 었으나, 보호관찰이나 전자감시제도 등에 관한 연구는 거의 이루 어지지 못한 실정이다. 이에 본 연구에서는 북유럽국가에서 현재 시행되는 사회내처 우제도의 실태와 운영 현황을 살펴봄으로써, 향후 이들의 제도적 이점과 효과적인 운영 방식 및 사례를 우리나라에 도입하고 제 도적 개선의 대안을 찾을 수 있는 기틀을 마련하고자 한다.
