Since January 1, 2020, the course of “Social Welfare Law” has been changed to “Social Welfare Law and Practice.” However, there has been confusion as it is taught without an understanding and consensus on what “practice” is. This study defined “practice” as in “legal practice” in the updated “Social Welfare Law and Practice” course and suggested a new direction on how to teach “legal practice” in three different aspects, keeping in mind that social workers are not legal experts or legal practitioners. One is the practical aspect for guaranteeing the rights of the citizens (clients), the other is the responsibilities and duties of social workers, and lastly, the practical aspect for changing the social welfare system. If this “legal practice” aspect is organized and taught in the “Social Welfare Law and Practice” course, it would not only be meaningful in terms of strengthening the professionalism of social workers but also developing a new type of expertise.

2020년 1월 1일부터 ‘사회복지법제’ 교과목이 ‘사회복지법제와 실천’으로 변경되어 교육되고 있다. 하지만 ‘실천’이 무엇인지에 대한 통찰과 합의 없이 교육되고 있어 혼란이 나타나고 있다. 이에 본 연구는 ‘사회복지법제와 실천’으로 변경된 교과목에서 ‘실천’은 ‘법적인 실천’이라 명명하였고, 사회복지사가 법 전문가나 법조인이 아니라는 점에서 ‘법적인 실천’을 어떻게 교육해야 하는지를 탐색하여 그 방향을 세 가지 측면에서 제시하였다. 하나는 국민(클라이언트)의 권리보장을 위한 실천 적 측면, 다른 하나는 사회복지사의 책임과 의무를 위한 실천적 측면 마지막으로 사회복지제도 변화를 위한 실천적 측면이 바로 그것이다. 이러한 ‘법적인 실천’의 내용이 ‘사회복지법제와 실천’ 교과목에 구성되어 교육된다면 사회복지사의 전문성이 강화될 뿐만 아니라 새로운 전문성의 개발이라는 측면에서 그 의의가 있다고 볼 수 있다.
