Since the enactment and enforcement in 1985, Act on Ownership and Management of Aggregate Buildings(hereinafter the ‘Act’) has been innovative and advanced through several amendments. Especially, to quickly solve the real problems, We have established our own rule, that is the Article 1-2. The Article 1-2 of the Act amended in 2003. It provides that partitioned stores or sectioned stores could be the object of ownership. But It was under conditions on act-use restriction; commercial facilities and transportation facilities and floor space restriction; not less than 1,000㎡. Through the 2020 amendment, floor space restriction clause has been deleted. Considering the legislative purpose of Article 1-2, It is desirable that act-use restriction clause is also deleted. Even if Article 1-2 of the Act is enacted, The doctrine on the sectional ownership of Article 1 of the Act should continue to develop. The doctrine development will be the basis for the formation of more detailed case law of the Supreme Court and the key to stably solve the real problems we face and will face.

집합건물법은 1985년 제정되어 시행된 이래 수차례 개정을 통하여 혁신적이고 선진적인 입법을 계속해 왔다. 특히 우리가 처한 현 실문제를 조속히 해결하기 위하여 우리만의 고유한 규정을 마련하 기도 하였다. 대표적으로 상가건물 구분소유권 성립에 관한 규정으 로서 법 제1조의2를 들 수 있다. 법 제1조의2는 상가건물의 구분점 포의 성립요건을 완화하기 위한 목적으로 2003년 신설되었다. 다만 그 입법 과정에서 절충적, 과도기적 장치로 그 규정 제1항 제1호 용 도제한, 제2호 면적제한 조항이 도입되었다가 2020년 개정을 통하 여 법 제1조의2 제1항 제2호 면적제한 조항이 삭제되었다. 당초의 법 제1조의2의 입법목적을 고려하면 제1호의 용도 제한 조항도 향 후 삭제되는 것이 바람직할 것이라 사료된다. 한편 상가건물의 구 분소유권에 관한 법 제1조의2가 도입되었다 하더라도, 법 제1조로 대표되는 구분소유권 성립에 관한 법리 발전은 계속되어야만 한다. 법 제1조 및 법 제1조의2를 아우르는 구분소유권 법리에 관한 충실 한 이론적 논의는, 결국 우리 대법원의 보다 세밀한 판례법리 형성 에 기초가 될 것이고, 이는 곧 우리가 마주한 그리고 마주하게 될 현실문제를 통일적이고 안정적으로 풀어내 줄 열쇠가 될 것이기 때문이다.
