This thesis explain the need for urban public art in urban space beyond the artistism through the flow of public art policies, and introduces the cases of urban art projects in Seoul city as an urban design policy. In addition, from an institutional point of view, it looks into the related policies and deliberation systems confusedly mixed with public art. Especially, the necessity to develop public art policies is explained from a critical point of view by the theorem organizing the relationship between the Public Design Promotion Act and various institutions dealing with sculptures. Currently, although the public art policy expands its boundary by other different laws for various reasons, there are systematic problems distributed and applied in related laws such as facilities and goods for sculptures due to absence of mother law. This thesis aims to establish a foundation for future public art policy promotion by comparing with preceding legal systems and revised regulations for public design art as an interdisciplinary approach.

본 논문은 도시공간을 대상으로 한 공공미술 정책의 흐름을 통해 작가주의를 넘은 도시형 공공미술의 필요성을 설명하 며 도시디자인정책으로써의 서울시 공공미술 정책사례를 소개한다. 더불어 제도적 관점에서 공공미술과 관련되어 혼재되 어있는 관련 제도들을 살펴본다. 특히 유관 정책으로 공공디자인진흥법과 조형물(造形物)을 다루고 있는 여러 제도들간 의 관계성 정리를 통해 공공미술 정책발전의 필요성을 비평적인 관점에서 정리하였다. 현재 공공미술 정책은 다양한 이유로 각자 다른 법령에 의해 외연을 확장하고 있으나, 중심을 이루는 모법(母法)의 부재 로 조형과 관계된 시설, 물품 등으로 각 유관법령 안에 분산되어 적용되고 있는 제도적인 문제점을 지적하고, 공공미술 정책 발전의 방향 모색을 위하여 교차적 영역으로써 공공디자인분야에서 선행된 법제도화와 기준정비의 내용을 비교함으 로써 향후 공공미술 정책진흥을 위한 기초를 마련하고자 한다.
