This study reviewed two issues of the Media Arbitration Act, which is currently being revised. First, a new type of news service that appeared in response to changes in the media environment is infringing on the personal rights of users on the Internet. Therefore, a method to include a new type of news service as a damage relief medium was reviewed in the Media Arbitration Act.Second, we reviewed the legislative direction of the right to request blocking of reading, which is being discussed as an effective way to relieve media damage occurring in the Internet space. In order to expand the new type of news service to the media subject to damage relief by including it in the Media Arbitration Act, it is judged that expanding the legal definition of the Internet news service is an effective method. By expanding the legal definition of internet news service, social media or search service providers can be included in the media for damage relief. In addition, it seems that the right to block access can be legislated if supplemented in a way that excludes reports dealing with the specificity of claim requirements or public signatures raised during the recent discussion of the amendment to the Media Arbitration Act.

이 연구는 최근 개정이 추진되고 있는 언론중재법의 두 가지 문제를 검토했다. 먼저미디어환경 변화에 따라 등장한 신유형 뉴스서비스는 인터넷상에서 이용자의 인격권을 침해하고 있다. 따라서 언론중재법에서 신유형 뉴스서비스를 피해구제 매체로 포함시킬 수 있는 방법을 검토했다. 두 번째로 인터넷공간에서 발생하는 언론피해를 구제하는 효과적인 방식으로 거론되고 있는 열람차단청구권의 입법방향을 검토했다. 신유형뉴스서비스를 언론중재법에 포섭해서 피해구제 대상매체로 확장하기 위해서는 인터넷뉴스서비스의 법적 정의 확장이 효과적인 방법으로 판단된다. 인터넷뉴스서비스의 법적 정의 확장으로 소셜미디어나 검색서비스사업자를 피해구제 대상매체에포함시킬 수 있다. 또한 열람차단 청구권은 최근 언론중재법 개정안 논의 과정에서 제기된 청구 요건의 구체성이나 공적 사인 등을 다룬 보도는 제외하는 방식으로 보완하면 입법 가능할 것으로 보인다.
