In 2020, Korea’s total fertility rate (the average number of children who would be born to a woman over her life time) hit a record low of 0.84, reduced by 0.08 from 0.92 in 2019. To increase the fertility rate, the establishment of a better environment for raising children should be a prerequisite. In this regard, it is necessary to improve a childcare leave system for the better environment, However, clerical personnel at private schools are in a blind zone where they can not receive childcare leave benefits. In this study, I present two proposals to remove such blind zone. The first proposal is to amend the provisions regarding clerical personnel under the Private School Act for applying the provisions regarding teachers mutatis mutandis to clerical personnel with respect to identity security or social security. The second proposal is to amend the Employment Insurance Act, which has applicable provisions for paying maternal and paternal leave allowance, to give an option to clerical personnel to be partially insured to unemployment allowance and maternal and paternal leave allowance. If any of two proposal is accepted, issues related to the payment of childcare leave allowance of clerical personnel at private schools can be resolved.

우리나라의 지난 2020년 합계출산율은 0.84명으로 전년(0.92명)보다 0.08명 감 소하여 역대 최저를 기록하였다. 이러한 출산율을 높이기 위해서는 무엇보다 아 이를 키울 수 있는 환경의 마련이 선행되어야 하는데, 그 중 하나가 육아휴직제 도의 마련이다. 하지만 사립학교 사무직원의 경우 육아휴직제도의 사각지대에 놓 여있어 이를 해소하기 위한 두 가지 방안을 제시하였다. 첫째, 「사립학교법」의 ‘사무직원’과 관련한 규정을 개정하여 신분보장이나 사회 보장과 관련한 규정의 경우 ‘교원의 규정을 준용’ 하도록 하는 방안을 제시하였 다. 둘째, 육아휴직 급여를 지급할 수 있는 근거 규정을 두고 있는 「고용보험법」의 개정을 통하여 사무직원의 경우 본인이 원하는 경우 ‘실업급여와 육아휴직급여 부분에 한정하여 가입’할 수 있도록 하는 방안을 제시하였다. 이 두 가지 방안이 사립학교 사무직원의 처우를 개선하는 밑거름이 되기를 희 망한다.
