Since January 2020, as the lockdown and sicoal distancing due to COVID-19 have been prolonged, healthcare and care services related to human life, health, and physical protection of people around the world have started to be recognized as more important tasks. At the same time, parcel service, delivery, street cleaning, and call center work, which had been treated as insignificant tasks, were newly recognized as important tasks for the safety of the public and maintenance of minimum daily and economic activities. In addition, countires around the world are designing and implementing various measures to protect these workers, naming them essential workers, core workers, or front-line workers. In Korea, a law to protect essential workers was enacted on May 18, and this law will be enforced on November 19, 2021. The law defines essential tasks and those workers engaged in the tasks and designates what the essential tasks are. Also the law has regulations about the establishment of a related employee support committee and a support plan by the Minister of Employment and Labor, and conducting a fact-finding survey. This thesis examines the background and progress of the enactment of the law related to essential business workers enacted during the COVID-19 crisis, and then reviews the content of the law.

2020년 1월 이후, 코로나19로 인한 봉쇄 및 사회적 거리두기가 장기화되면서, 전 세계적으로 국민의 생명 건강 및 신체 보호와 관련된 보건의료 돌봄서비스 업 무와 그 동안 중요하지 않은 업무로 취급되던 택배 배달 업무, 환경미화업무, 콜 센터 업무 등이 국민 안전, 최소한의 일상 및 경제활동 유지를 위한 중요업무로 부상되었다. 그리고 세계 각국은 이러한 업무에 종사하는 노동자를 필수노동자, 핵심노동자, 최전방 노동자 등으로 칭하면서, 보호를 위한 대책을 설계 시행하고 있다. 우리나라도 지난 5월 18일 필수노동자를 보호하기 위한 법이 제정되었고, 2021 년 11월 19일부터 시행될 예정이다. 법은 필수업무와 필수업무 종사자의 정의와 필수업무 지정 및 종사자 지원위원회 설치, 고용노동부장관의 지원계획 수립, 실 태조사 실시 등의 내용을 규정하고 있다. 본고는 코로나19 위기 속에서 제정된 필수업무종사자법의 제정 배경 및 경과를 살펴본 후, 그 법의 내용에 대해서 검토한다.
