Information disclosure during an infectious disease crisis, newly established through the revision of the Infectious Disease Prevention and Management Act, is the disclosure of infectious disease-related information collected through epidemiological investigations by the state or local governments. However, while arranging the crisis, the state or local governments leaked personal information that was not needed by the public for preventing, managing, or responding to infectious diseases. Similarly, a situation in which the information was secondarily processed and spread through the media occurred. Such occurrences could infringe on the patients’ privacy related to infectious diseases and may seriously damage their reputation if disclosed. As announced by the state or local governments, the media’s transmission of personal information related to infectious diseases conforms with the laws or guidelines at the time. Thus, only the state or local governments can bear responsibility in this case. Nevertheless, there is a possibility that the media may also be held responsible for the violation of the patients’ personality rights with infectious diseases by processing or expanding their published personal information. In this paper, I will focus on whether the right to be forgotten can be recognized for patients with infectious diseases and whether there are legal remedies for the media if their publicity has violated personal rights.

감염병 위기 시 정보공개는 국가나 지방자치단체가 역학조사를 통하여 수집된 감염병 관련 정보들 중 일부를 공개하는 것으로, ｢감염병의 예방 및 관리에 관한 법률｣의 개정을 통하여 신설되었다. 그러나 국가나 지방 자치단체는 제도의 운용 과정에서 감염병 예방 및 관리나 대응을 위하여 국민들에게 필요하지 않고 공개될 경우 감염병 환자의 사생활을 침해하 고 명예를 심각하게 훼손할 수 있는 개인 정보를 누출하기도 하였고, 그 정보는 미디어를 통하여 2차적으로 가공되어 확산되는 상황까지 발생한 바 있다. 이때 국가나 지방자치단체가 공표한 감염병 관련 개인 정보를 미디어가 전달하는 것은 당시의 법령이나 지침에 따른 것으로, 그 과정에 서 감염병과 무관한 개인 정보의 유출로 인하여 발생한 감염병 환자의 인격권 침해는 국가나 지방자치단체만이 책임을 부담할 소지가 있다. 그 러나 미디어가 그 공표된 개인 정보를 가공 혹은 확장시킴으로써 감염병 환자의 인격권이 침해된 부분은 미디어의 책임 부담 가능성이 존재한다. 본고에서는 해당 감염병 환자에게 잊힐 권리를 인정할 수 있는지 및 미디어의 공표가 명예훼손에 이르러 인격권이 침해된 경우 어떠한 피해 구제수단이 존재하는지를 중심으로 살펴보고자 한다.
