This thesis analyzes the territorial issue between Korea and Japan over Dokdo. In this regard, Japan’s claim for sovereignty over Dokdo can be seen in four ways. First, the ground for the sovereignty claim on Dokdo cannot be found in Korea. Second, the Japanese fishermen worked in Dokdo since 17th century because Japan has been aware of Dokdo since then. Third, Japan already included Dokdo in their map representing as Japanese territory from early time. Fourth, Dokdo became a territory of Japan based on modern logics because it was the place where Japanese people ran business in the early 20th century. However, the documents underlying Japan's claim of Dokdo sovereignty remarked that Dokdo has nothing to do with Japan. For example, the OyaMurakawa Fisheries Document, where Japan uses Dokdo as the basis for its indigenous territory, but OyaMurakawa Fisheries Document said that Dokdo was a subsidiary island of Ulleungdo rather than Japan. In addition, Shimane Prefecture Notice No. 40 in 1905 reveals the illegality of Japan's compulsory incorporation of Dokdo. Therefore, this thesis analyzes why the modern logics of Japan's claim of Dokdo sovereignty is contradictory, and furthermore, why the postwar Korean ownership of Dokdo is legal.

이 논문은 독도영유를 둘러싼 한일 간의 쟁점사안에 대해서 분석하고 있다. 전후 한국영토가 된 독도에 대해서 일본은 매년 외교문서를 통해 독도영유를 주장해오고 있다. 일본의 이러한 행위는 한일 간 현안이 되어 자주 외교문제가 되기도 한다. 일 본에 의한 독도영유주장은 이하 네 가지로 볼 수 있다. 첫째, 한국의 독도영유주장은 그 근거를 찾을 수 없다. 둘째, 일본어부들은 17세 기에 울릉도근해에서 어업을 했으며 일본은 이때부터 독도를 인지하고 있었다. 셋 째, 일본은 일찍이 일본영역을 나타내는 지도에 독도를 포함시키고 있었다. 그리고 넷째, 독도는 20세기 초 일본인들이 사업을 경영하던 터전이었기에 근대논리에 근거 해서 일본의 영토가 되었다는 것이다. 그래서 이 논문은 일본이 주장하는 독도영유에 대해서 그 근거를 분석하고 더 나 아가서는 일본이 주장하는 독도에 대한 영유주장과 근대논리가 왜 모순인지를 설명 하고 있다. 일본은 외무성 홈페이지를 중심으로 독도가 왜 일본의 영토이며 동시에 한국의 독도영유주장이 잘못인지에 대해서 홍보하고 있다. 그러나 일본의 독도영유주장의 근거가 되는 자료들은 오히려 독도가 일본과는 무 관하다는 내용들이다. 예를 들면, 일본이 독도를 고유영토의 근거로 사용하고 있는 오야・무라카와 어업문서는 독도가 울릉도의 부속 섬임을 기록하고 있다. 그리고 1905년 시마네현 고시40호는 일본의 독도강제편입의 불법성을 드러내고 있다. 그래 서 이 논문은 일본의 독도영유주장에 대한 근세・근대논리가 왜 모순이며 더 나아 가서는 전후 한국의 독도영유가 왜 합법인지에 대해서 분석하고 있다.
