Recently, the arrangement of popular music has diversified due to the development of various information and communication technologies, and based on this, new creators of content production are increasing. Existing music works are being created based on original songs such as cover and remake through various musical techniques and technical elements, especially popular music. We would like to discuss how to judge the practical similarities between two or more remakes of a second piece of music. In the event of a dispute between two or more secondary works derived from a single piece of music, the idea of the original song is sued to determine the practical similarity, the idea of the unprotected part of the public domain, and the idea of the original part leaves only a small creativity to create the secondary work. Therefore, we would like to analyze which part of music the aforementioned creativity falls into.

최근 과학기술의 발전에 의해 대중음악의 편곡이 다양화되며 기존의 음악저작물은 다양한 음 악적 기법과 기술적 요소를 통해 특히 대중음악을 통해 커버(cover), 리메이크(remake) 등 원곡 을 기반으로 새로운 2차적저작물을 만들어지고 있다. 하나의 악곡에서의 2차적 저작물이 두 개 이상의 리메이크곡이 나올 시 그 리메이크 곡사이의 실질적 유사성을 어떻게 판단할지에 대해 논해보고자 한다. 우리 법원 판례의 태도에 따르면 2차적저작물에 있어 원곡에 새로운 창작성을 부가할 시 2차적저작물로 본다. 하나의 악곡에서 파생된 2개 이상의 2차적저작물간의 분쟁이 생 길 시 실질적 유사성에 대한 판단하기 위해 원곡의 아이디어인 부분을 소고하며, 보호받지 못하 는 부분인 퍼블릭도메인을 빼고 그리고 원곡부분의 아이디어를 빼게 되면 2차적저작물을 만들기 위한 작은 창작성만이 남게 된다. 따라서 본 고에서는 앞서 말한 창작성이 대체 어느 음악부분에 해당하는가에 대해 분석해보고자 한다.
