A Review on Several Legal Issues in the State Litigation Related to COVID-19 Quarantine Violations: from the Viewpoint of Public Law

As various measures have been taken by the State and local governments to block and prevent the spread of the infection of COVID-19, various lawsuits have been filed for violations of quarantine in this regard. This thesis focuses on categorizing the actually filed cases in the state litigation for violating matters related to the COVID-19 quarantine, and reviewing the issues from a public law perspective. The scope of ‘state litigation’ herein shall be determined by civil lawsuits in which the State or local government becomes the litigant. As a type of lawsuit in which the State is the plaintiff, the lawsuit seeking reimbursement or state compensation for violations of COVID-19 quarantine measures has a problem from the standpoint of the principle of the rule of law, as it is indirectly creating sanctions for administrative violations through civil lawsuits. Also, this lawsuit may violate the principle of proportionality and equality in that the amount of the claim is excessive. In the case of lawsuits in which the State or local government is the defendant, the following points can be controversial: the illegality of the violation of the State's obligation to take action against the outbreak of the COVID-19 mass infection, the violation of the principle of equality and proportionality due to selective collective restrictions or prohibitions, infringement on fundamental rights and illegality due to extensive epidemiological investigations and forced provision of location information. It is hoped that this study, through categorizing actual cases and reviewing them from a public law point of view, will serve as an opportunity to emphasize the role of public law in the social disaster situation of COVID-19 and contribute even a little to promoting follow-up studies.

코로나 19의 감염 전파를 차단하고 예방하기 위한 국가와 지방자치단체의 여러 조치가 취해지면서 이와 관련하여 방역 위반을 이유로 한 각종 소송이 제기되고 있다. 본 논문에서는 코로나 19 방역에 관련된 사항을 위반하였음을 이유로 한 국가소송 중 실제로 소가 제기된 사안을 유형화하고 공법적 시각에서 쟁점을 검토한다. 여기서 다루는 ‘국가소송’은 국가뿐만 아니라 지방자치단체가 원고 또는 피고가 되는 민사소송으로 그 범위를 정한다. 국가 등이 원고가 되는 소송유형으로서 코로나 19 방역 조치 위반을 이유로 한 구상금 청구나 국가배상청구 소송은, 그 실질이 민사소송을 통해 행정상 의무위반의 제재조치를 우회적으로 창설하는 것으로서 법치주의적 관점에서 문제가 있고, 그 청구액수가 과도하다는 점에서 비례원칙과 평등원칙에 위반될 수 있다. 국가 등이 피고가 되는 소송유형에서는 코로나 19 집단 감염 발생에 대한 국가 등의 조치의무 위반의 위법성, 선별적 집합제한ㆍ금지 조치의 평등원칙ㆍ비례원칙 위반의 문제, 광범위한 역학조사와 위치정보 강제제공의 기본권 침해와 위법성이 쟁점이 될 수 있다. 본 연구가 실제 소제기 사안의 구체적 유형화와 공법적 검토를 통해 코로나 19의 사회적 재난상황에서 공법학의 역할을 강조하고 후속 연구를 촉진하는 데에 조금이라도 기여할 수 있기를 기대한다.
