Many scholars have criticized traditional American juvenile justice system which is based on rehabilitation philosophy. Those criticisms come from two camps. One is based upon the failure of traditional juvenile justice system in reducing juvenile delinquency and the other comes from poor protection of legal rights of juvenile offenders. Korean juvenile justice system also failed to reduce juvenile delinquency, which in turn suggests new paradigms. However, reviving punishment-oriented policy should not be the answer because the punishment was not successful to reduce juvenile delinquency. Thus, future discussion on improving juvenile justice system should focus on such things as the legal protection of juvenile offenders, equal protection of law to all youths, enhancing the educational programs in detention facilities and restoring the harm done to crime victims.
