The restorative justice program for prisoners in Korea was targeted at juvenile inmates in Anyang Prison in 2001, relatively early days. The world famous Sycamore Tree program as Victim awareness programs was widely adopted in prison. In 2006, the Correctional Bureau of Ministry of Justice officially proposed restorative justice as a policy for the implementation of prisons for the first time. Victim awareness and empathy programs such as Sycamore Tree program for adult inmates and Role Lettering for victims were started. In addition, inmates collected work incentives and transferred money to victims' rescue organizations or conducted volunteer activities in community widely. Recently, in 2020, Busan Prison conducted a pre-education of pilot participation of restorative prison project and circle program for correctional officials and prisoners on the restorative prison project. Furthermore, one of the most challenging issues in Korean prisons was the implementation of nonviolent conversation(NVC) and circle program for inmates who refuse to enter the prison cell, which verify its effectiveness. Although the restorative judicial regulation is not being implemented reliably in prisons, it is expected that various pilot attempts will help understand and settle restorative justice. In addition to the prospect of the prison application of restorative justice, the need for future policy suggestions and follow-up research was presented.

우리나라 교도소에서의 회복적 사법 적용은 아시아에서는 유 래가 없을 정도로 매우 이른 시기인 2001년 안양교도소에서 소 년수형자들을 대상으로 피해자 공감 “Sycamore Tree Program”을 적용하였다. 본 논문은 그동안 교도소 등 교정시설 에서 실행되었던 회복적 사법 프로그램 적용 실태를 문헌연구를 통해 전반적으로 살펴보았다. 피해자 입장에서 편지 쓰기 등 피 해자 인식 및 공감 프로그램과 피해자에 대한 배상, 지역사회 봉 사활동 등 다양한 교도소에서의 회복적 사법 실천 사례를 우리 나라에서도 상당수 적용해 왔음을 확인하였다. 특히 오랫동안 교 정교화 처우를 적용하지 못하고 있는 입실거부 수용자에 대하여 회복적 사법 프로그램을 적용하고 그 효과성을 검증해 보고자 하였는데 참여 수용자들에 대한 사전사후 심리검사 결과 자기존 중감과 분노통제, 충동성 및 공격성 등 각 임상척도에서 대부분 긍정적인 영향을 미친것으로 나타났다. 회복적 사법이 우리나라 교도소에 아직 제도적으로 정착된 단계는 아니지만 여러 시범 시도들이 회복적 사법에 대한 이해와 확산에 도움을 줄 것으로 기대되는 상황으로 회복적 사법 향후 적용 전망과 더불어 정책 적 제언과 후속연구의 필요성에 대해 제시하였다.
