This essay aims at to show that Hume’s claim of the scope of justice in his theory of Justice, which is said in his An Enquiry concerning the Principles of Morals, seems to exclude women because they have no property, but when we consider Hume’s viewpoint on women and family, which are said in An Enquiry concerning the Principles of Morals and A Treatise of Human Nature, we can find a possibility of conclusion that in the theory of Justice with respect to family-society women are in the scope of justice. According to Hume, justice is useful to society. If constructing a relationship of convention with women in a family-society is useful, then it can be justice. Women can be inside of the scope of justice not because of a possibility of having their property but because of usefulness to the family-society by forming relationship of convention (with women) for common interest of family- society. To show this several significant paragraphs about justice, the scope of it, and the viewpoint of women in A Treatise of Human Nature and An Enquiry concerning the Principles of Morals are cited. Finally when we focus on the definition on justice that is artificial virtue and is for protection of property, we can say that in family-society women are in the scope of Hume’s justice.
