Study on Non-discrimination Principle in the Government Procurement Agreement of WTO and Its Exceptions -Focus on the Countermeasures of China

As one of the basic principles of WTO system, non-discrimination is reflected as national treatment and most-favored-nation treatment, and it is the same in the Government Procurement Agreement (GPA). This thesis has an analysis on the features of non-discrimination and its exceptions in the field of GPA by the interpretation of the non-discrimination clauses in GPA2012. The second part introduces the exceptions of non-discrimination principle applied by several parties in participating in GPA in order to provide references for China. Finally, this thesis focuses on the current legislation of government procurement and its conflicts against the non-discrimination principle in GPA, and then proposes the countermeasures of China during the negotiation on participation in GPA. 非歧视原则体现为国民待遇与最惠国待遇, 作为WTO体制的一项基本原则, 在 ≪政府采购协议≫(GPA)中亦不例外。本文先通过解读GPA2012中的非歧视原则 条款, 分析该原则在GPA领域的自身特点, 并概括其适用的例外情形。第二部分 则选取了几个有参考价值的参加方, 介绍其在加入GPA时对非歧视原则例外适用 的具体做法, 以期对我国提供借鉴。最后, 本文落脚于中国政府采购法制现状以 及与GPA非歧视原则之冲突, 并提出中国在商谈加入GPA时对该原则的应对策略。
