In this study, we discussed the minimum academic achievement policy in place and as a way to ensure student athletes' right for learning. The minimum academic achievement policy aims to guarantee student athletes' right for learning, but it is controversial because other problems are occurring in the process of achieving that goal. Therefore, the purpose of this study is to discuss the two sides of the minimum academic achievement policy and to present future directions. Since the minimum academic achievement policy can raise the issue of consistency or equity, the issue of fairness, which can be called the essence of sports, can emerge. To address these fairness issues, three measures have been proposed in this study. First, it is the use of a basic education guarantee system for all students. Second, it is not just a way to meet the minimum academic standards, but a solution to the fundamental problem through the realization of class participation. Third, it is the introduction of a method to measure the improvement of grades so that even students who have not reached the minimum level of education can be recognized if their grades have improved compared to the past.

본 연구에서는 학생선수들의 학습권을 보장하기 위한 방안으로 마련되고 시행 중인 최저학력제에 대해 논의하였 다. 최저학력제는 학생선수들의 학습권 보장이라는 목적이 있지만, 그 목적을 달성하기 위한 과정에서 다른 문제가 발생하 고 있기 때문에 논란이 되고 있다. 따라서 본 연구에서는 최저학력제의 양면성에 대해 논의하고, 향후 방향에 대해 제시하 는 데 목적이 있다. 최저학력제는 일관성이나 형평성의 문제가 제기될 수 있기 때문에 스포츠의 본질이라고 할 수 있는 공정성 문제가 대두될 수 있다. 이러한 공정성 문제를 해소하기 위해 이 연구에서는 3가지 방안을 제시하였다. 첫째, 모든 학생들을 대상으로 하는 기초학력보장 제도의 활용이다. 둘째, 단순히 최저학력 기준을 맞추기 위한 방안이 아닌 수업 참여의 현실화를 통한 근본 문제 해결이다. 셋째, 최저학력 수준에 미도달한 학생이더라도 과거보다 성적이 향상하였다면 인정해줄 수 있도록 성적 향상도를 측정하는 방법의 도입이다.
